Hey guys,

I have a question about filing taxes while we’re in the middle of this stuff. I am a U.S. Citizen and my husband resides outside of the country, and we have a pending I-130. It was approved/sent to the NVC on Jan. 13th, and we’re still waiting for NVC to receive/assign us a case number.

I wanted to go ahead and file taxes for 2013 so I have 2011-2013 tax years when they request my income information. However I ran into a roadblock (am using TurboTax). It asks (1) if you are married, (2) for your spouse’s name and (3) their social security number.

Of course at this point none of our spouses would have SSN’s, so I am unsure of how to proceed. I am filing separately but of course need to list that I have a spouse, especially if I’m going to include it in the immigration evidence.

Have any of you had experience with this? Were you able to resolve?

That's disappointing. Maybe I am just bitter cause I live in a state where we don't get snow days.

Shouldn't be a problem. Have you checked your case status? When ours got mailed they updated the case status.

Yeah, we don't have snow days here either but in the summer we have hurricane days. Lol! :).

Unfortunately, for the first year, you won't be able to file taxes online. It'll have to be done on paper. If you're doing MFS, then write 'NRA' (non-resident alien) in the SSN field of the foreign spouse.

Generally speaking, you have following options:

- File married but separate - no issues with SSN or TIN

- After filing above you can file a modification - i think you have three years to modify your tax return. By this time you'll have a SSN for your spouse

- File married and joint - you'll have to apply for TIN

- There are some head of household options but I am not familiar enough with it to comment.

Sorry I misunderstood your question-

In turbotax you have the option to directly input some of the information in the form format. I haven't tried to do it with this specific issue, but you can give it a shot.. Under the 'View' menu option click on Forms rather than step-by-step. Click on the Info Wks and try to modify the SSN to 'NA' or 'unavailable'

The State ID number is used to pay your sales tax and employee withholding on the state level

and is different from the EIN which is for federal employment tax deposits

Honestly i went through all my paperwork, and i didn't see anything about State ID number. There is EIN number, Transaction ID #, Local Trans ID, License number and that's about it.

Hi all

So I have all the documents and I'm going to send my IV pack tomorrow to arrive at NVC early next week. I have some free time tonight so I want to do my DS260. Will it matter if I submit this before they receive the IV? Also my wife is not sending her AOS until next week as she is waiting on pay-stubs, does this matter in terms of my IV and DS260? I'm pretty sure I can go ahead and sort my stuff out before she sorts out hers but just want to make sure!

O wow, i just see that Part 7 is not required to be filled out if you are the sponsor.

Part 7. Information on Preparer, if prepared by someone other then the sponsor.

So, do i live all that blank or do i put ''none'' and n/a where needed ?

Doesn't matter what order NVC receives the packages. As long as they get them all in the end, they could care less.

Yup. Do whatever you want first. As I said, as long as NVC gets everything, they could care less what order it's in.

We're in the midst of this now ourselves with an accountant. The options listed above are your choices. However, you have to keep in mind that the choice between MFS and MFJ can be complicated; there are differences in how the foreign income is taxed based on type, state (of petitioner), and duration of marriage (they pro-rate on how much of the year you were married). There are also differences in exemptions between federal taxes and state taxes. So filing jointly, which is much more complicated, may not actually give you a significant tax benifit.
