affidavits are some of the lowest forms of evidence you can send. It doesn't matter if they're from a USC or not. I assume you mean to send them with the IV package.

I sent around 15 notarized affidavits from family members and friends, all of whom were USC's when I sent in my I130 package. One was from an attorney, one from a current warrant officer in the US army, and one from a retired US air force officer. I don't know if it helped, but I never got an RFE. We didn't get affidavits from Dutch people who knew us as married because we wanted them to be notarized, and that's ridiculously expensive over there. I don't think that it would be weighed more just because they were a USC if there's good reason for you to have a lot of foreign contacts who know that you're married. But that's just conjecture on my part, I don't know anywhere that it specifically states that one is better than another.

Hi Saylin! I need your expertise on this. Or if there is anybody out there having the same situation as we are. My USC husband petitioned me and my daughter from a previous relationship (not married). We are on the NVC stage right now and I am just making sure I have all the necessary documents for her. I have included in her IV packet the following documents.

Bar coded sheet

2x2 passport size pics

Copy of biographic page of passport

Original Birth Cert from NSO

A letter explaining the nature of the following documents below.

- Affidavit of illegitimacy

- Affidavit of Sole Custody

- Copy of Section 1. Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines

1 set photocopy of the above documents

Do I need to include an Original copy of my Birth Certificate as well as our Marriage certificate?

I'm not too knowledgeable with child visas, but it sounds like you covered everything. I'd include a copy of your birth and marriage certificate just for good measure.

NVC website says, must submit NVC original civil documents.

Remember, you have to submit BOTH. If you just send photocopies, you WILL get a checklist for the originals/certified copies.

I emailed NVC on Jan 23 requesting a status on my husband DS261. I received this email yesterday afternoon. Does this mean my husband case is on hold until they received my AOS packet? I mailed out my civil documents on Jan 14 and NVC received Jan 15. Also, I never received an email for the AOS checklist . I haven't sent out my AOS packet because am going to use my 2013 tax return to qualify without a co-sponsor. Am just waiting for my 1099 from my night job which I have been requesting a copy from them since last week.

"A letter was sent to the petitioner or attorney of record indicating the

Affidavit of Support requirement for this case is incomplete. Please

submit the requested Affidavit of Support form(s) and/or financial

evidence, as indicated on the checklist. The requested information must

Why are you concerned about the DS-261 status when you've paid the IV bill (which is only invoiced after the DS-261 has been added to the case file) and submitted the DS-260?

Unless you recieved an email saying to fill out the I-864 just leave the first blank. The second is when you sent the package yes.

The timeline is the same one used when you couldnt download forms and had to wait for them to be sent to you. Life has speeded up quite a bit since VJ was created. People should be thankful instead of complaining so much IMHO. smile.png

No, I know that they'll need to prove their income. We already have that information. I have my Dutch Tax returns, which I'll be adding in to prove that I had been living and working in the Netherlands up until I moved back. I'm just concerned that we're going to get it kicked back for not being the correct form for whatever reason. I am confident that we will not need to show their assets due to my grandmother's high income. But yes, obviously we will be submitting the information about her pension and my grandfathers investments along with their tax transcripts.

I'm not sure how it would work in India. I know that here in the US, you find a notary public, and present them with the letter. Then you swear in front of them that the statement is true. They stamp it. You might have to pay them a small fee for the service. Similar in the Netherlands, as well. Except that they charge at least 30 euros per affidavit.


People should be thankful instead of complaining so much IMHO. smile.png

You would hate the Netherlands. Complaining is their national past time. :P

Today is definitely not a good day :( I am so over this already. Wait....Wait...Wait....Did you see a member who got transferred and got number on the next day ?

No but I saw a member that got shipped one day and recieved the next day. It took us 28 days to be recieved! This waiting is killing me. I thought once we got to NVC it would speed up. So tired of waiting............:(

They didn't for us. I think they only asked for a driver's license. A few people got them done at work, so they were already known to the notaries. I'm guessing that they didn't require proof of identity from them. :)

Noooooooo for the being closed! sad.png Weather has been fairly bad in NYC, but the worst part for me is commuting to long island...I have to walk close to a mile to the train which today was in about a foot of slush with freezing rain....also one of the trains caught fire today. So yeah. While I can totally support businesses being closed for the weather (especially places where it is much worse than here) I am still impatient. lol

Affidavits do not need to be notarized. In the USA all that says is someone watched them sign it, not that the information is correct. I think that's why its so cheap here. We did send two affidavits, one from his best friend whi is a SSgt in the USAF and my mother who is a minister and married us. We had a few pictures, but our main evidence was that we had a joint bank account and he added me to his vehicle insurance.

So in response to my service request last week, I received a letter from USCIS on Feb. 2 stating that they have sent the petition to NVC. Just this morning I called USCIS wanting to know the exact date they sent the petition to NVC. The representative I spoke with told me she will have an officer call me back since they can't do another service request if it is less than a month from the previous service request. Is it okay to ask when the exact date they sent the petition to NVC?

Shouldn't be a problem. Have you checked your case status? When ours got mailed they updated the case status.
