Received an email checklist asking me to complete DS-261 on line! I did complete DS-261 on Jan 30 and status shows completed. Is this a false check list?

Received a second email checklist for I-864: item 13a(1) should match the gross income from federal tax return; have to correct and resubmit I-864 :-(

Everyone,
Just came back from the attorney's office. I have GOOD news for you ALL. Bad news for me though..... mad.gif
I checked the I-864 which submitted to AOS last month and they have mentioned tax return years as 2013, 2012 and 2011. ranting33va.gifdevil.gif

Instead they should have mentioned 2012, 2011 and 2010 cause I submitted tax return for these years to attorney's office. So the good news is. Yes, they still accept 2012, 2011 and 2010 as last 3 years for tax return. BAD news is my attorney screwed up again.

My attorney apologized for the whole delay and he knew it's his firm did all the mistakes. But the truth is the paralegal worked on this made all these mistakes and he was not apologetic and trying to say it is my fault. That pissed me off! diablo.gifdiablo.gifdiablo.gif

Anyway, we filled new I-864 with 2013 tax returns as I have filed 2013 few weeks back, and will be delivered to NVC tomorrow morning (new AOS). The really BAD thing here is I'm on F2A and there is an indication that priority dates might retrogress in the next couple of months. If that happens I may have to wait years to bring my spouse.... leaving we no choice but alien.gif that paralegal.

Called NVC. They said ignore DS-261 false check list and concentrate on resubmitting corrected I-864.

IV processing fee invoice will take a few more days.

i have a dilemma regarding my taxes, anyone wanna comment?

i'm domiciled in california, which is a community property state. in other words, any income i earned after the marriage is considered a 50-50 split with my wife. the way i see it, i have 2 options:

1. MFS (and amend to MFJ after wife receives SSN). Benefit here is that I don't need a SSN/ITIN for my wife. Drawback is the extra $ i will owe, as well as the complexities introduced by the community property rules. due to these rules, does she need to file a tax extension if we go this route?

2. MFJ. I will take a trip to see my wife in april and return on april 11. if i prepare my taxes and have her sign the return+ITIN documents, I should be able to mail everything off prior to april 15. The only drawback I see here is that the tax transcript may not be available in time for the interview.

what do you guys think?

Hi, not sure how/ if this helps... My husband lives in California. He hires the same person to file our taxes. Last year and this year, since I've been in Brazil, she had me sign "Form 8879: IRS e-file Signature Authorization", for federal and one for California (California e-file Signature Authorization for Individuals). Now, the good news is... I could sign electronically! I have an app on the iPad and signed the two forms right there. Then, I emailed it back to her.

Unless your wife has a copy of her passport certified by the consulate or embassy in India, she will have to submit her PASSPORT (or other original documents in lieu of her passport) with the ITIN application. Choose carefully. The IRS can hold the passport for 60 days! I had my spouse send her passport to the consulate in Sydney Australia - it only took 5 days (and $50). Being without a passport at this stage of your application could really hurt you.

You don't need the 2013 tax transcript for the interview - but your spouse will have to carry a FULL copy of your 2013 Federal Tax Return.

I have a question about the documents to send with IV package.

Is there any advantage or disadvantage in sending original documents vs certified copies? From what I understand only birth certificate and marriage certificate have that option. PCC should be original.

If its all the same, I'd rather send copies.

By 'certified copy', they mean notarized copy right? Or is it something else?

Certified copy =/= notarized copy. As another member said, a certified copy is a copy of the original from the issuing agency. If you can get a certified copy, I'd suggest sending that instead of the original.

we got our case number on 20 feb n just yesterday the iv n AOS bill shown that need to b paid although we didn't fill in the ds261 yet when my wife called nvc they told her that because of out agent which is our lawyer but we fired her back in spetmber n the link of paying still not avilable??n we havent recive any emails yet?? is that normal>> also one more quiz when we fill the forms is which family name we write for my wife ? before marrige or our family name?

Seems like the lawyer is still attached to your case if the IV bill was invoiced with the AOS bill. I'd call NVC up and tell them about you firing the lawyer.

Did you give over both email addresses when the case number was assigned?

And you use whatever last name your wife is currently using. If she legally changed her name to her married name, then use that. If she didn't change it, then use her maiden name. I hadn't (and still haven't) changed my last name, so I used my maiden name.

Could someone please update the spreadsheet. The service center is CSC not NBC.

Never mind LOL. Original service center was NBC, then transferred to CSC. Guess it doesn't really matter

And I took NBC from your timeline. But I'm trying to use the service center the petition was approved at (as that's where the petition is being sent from), so I updated yours to California :)

Checklist for the DS-261 is a fake, based on them reviewing your AOS package.
