Is it necessary to file I864EZ just because we do EP? I did EP in my case but filed I864 both from petitioner and a joint sponsor.

No..the conditions to use I-864EZ should be met, there are three conditions mentioned to be qualified not just because we do EP.

This is what USCIS says regarding I-864EZ:

Who may use form I-864EZ?

You may use Form I-864EZ IF ALL the following conditions apply:
1.You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;
2.The relative you are sponsoring is the only person listed on the Form I-130 petition;
3.The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s).

Since you have a joint sponsor you are not qualified, you did the right thing.

This is what USCIS says:

Who may not use Form I-864EZ?

You must complete Form I-864 (and not Form I-864EZ) if any of the following conditions apply:

1. The relative you are sponsoring is not the only person immigrating base upon the underlying visa petition;

2. You filed or are filing a Form I-140, Immigrant petition for Alien Worker, for the immigrant you are sponsoring;

3. You are a joint sponsor;

4, You are a substitute sponsor filing because the original I-130 petitioner is deceased.

quick random question... the I-864 instructions say either "type or print" - for the instructions for line 30 it says print, and then we have to sign and date on 31... does that mean we have to handwrite i.e. "print" our name on line 30? I already sent my 864 in, and after reading the whole fiasco about not mixing "typing" and "printing" (I typed my form but in a lot of places I was unable to put N/A so I hand filled that in after I printed my form) I'm freaking out - don't want to get a checklist for something so minor!

NVC is moving at a snails pace the last couple weeks. Meanwhile the conditions in Kiev are not getting better....

Depending on the conditions, you can try requesting for an expedite.

Another question:

I was an Au Pair back in 2008/2009 in the US, so I had a J1 Visa and received a SSN. Of course the SSN is expired by now, because it was only valid with the J1, but I believe I will have the same number once my Green Card is done.

My husband and I are wondering now that especially with the tax stuff if we should put that number in there or stay with the NRA for the SSN? I mean technically for my name there is an excisting SSN, doesnt matter if its valid right now or not.

Anyone any excperience with that?

As another member said, SSNs don't technically expired. But, you should call up an SSA agency and ask about that. Because I would think you'd be able to use it for taxes.

Hi guys! Quick question. When you get your case number you usually give your email address right? my question is, what is in that email? and how long before you receive email from them (NVC)? Thank you so much.

Yes, most people (if they remember) give over the email addresses as soon as the case number is assigned. The first email you receive from NVC is just information such as your case numbers, how to contact them, etc.

Additional evidence is not required here. If you have all the civil docs below then you're good to go..

What is needed in the IV package?

Generally, the following is needed:

- Bar-coded cover sheet from payment portal

- Two passport-style photographs (2" x 2") of beneficiary (on the back, write: beneficiary's full name, date of birth, and case number)

- Copy of bio-data page of beneficiary's unexpired passport

- Original or Certified Copy of beneficiary's birth certificate, PLUS A PHOTOCOPY

- Original or Certified Copy of marriage certificate, PLUS A PHOTOCOPY

- Original police certificate(s)

Also read the country-specific documents linked in the first post. There may be additional documents needed not listed above.

As it's already been discussed in this thread, it may not be required per se, but recommended for those going through high-fraud countries since in most, if not all, cases, the officer has already made a decision before the interview. So, because of this, some people want the officer to have more evidence in front of them to better their chances.

For Canadians - My case complete was April 15th 2013 and my interview was June 3rd, 2013. I did not send 2012 taxes with the AOS information and it was not asked for at the NVC stage. My husband filed for an extension and I brought the proof it was filed for, but that proof was not asked for at the interview. They simply asked to have my I-864EZ (since I did EP) and that was it. Other countries may ask to see the current year's taxes after the April 15th date, but Montreal did not.

Weird... Cause I had my case complete in March and interview in May and I had to give over the latest year's tax information.

The form you use isn't dependent on EP or not. The I-864EZ is a shorter form, but you need to qualify for it. And even if you do, it's not necessary to fill out.

If I were to choose EP for Montreal, and filed my forms electronically, could my US husband file the AOS by snail mail? Or is it an 'all or nothing' when it comes to EP?

He's just worried he might miss something in scanning all the documents from himself (I864), our co-sponsor (I864), and the co-sponsor's husband as they filed taxes jointly (I864a).

Nope, it's all or nothing. If you enroll for EP, then send something by snail mail, it will likely cause a delay in your case. Perhaps in your case, just don't enroll for EP.

It's possible because of him meeting the guidelines for several years, as USAF veteran, and then working for the government for the FAA that we didn't have to. Or maybe the CO just was too busy thinking of my constant skype time to ask? Dirty man. Lol.

Agreed. Just because you're going to Montreal doesn't mean you HAVE to do EP, it's still optional for Canada. :)

Agreed. Just because you're going to Montreal doesn't mean you HAVE to do EP, it's still optional for Canada. smile.png

just wanna ask, what are the possible reasons for the IV fee bill to take so long to be invoiced/available.?

I tried it but didn't let me.

Beneficiary's phone number is free format so I can type long phone number.

But petitioer's phone number has US style format, which shows" (___) ___-___"

Only 10 digit number can fit there...

I went back and check my DS 260 copies, you are right, there was one place where I wasn't able to fit all number, so I used only 10 digits. I used only area code and telephone number from Mexico. Since previous question is asking for the address outside the USA (Mexico, in my case) is understood to dial this number, they have to dial international call prefix and country calling code before calling phone number. (123) 456-7890

Hi Saylin,

India's passport office does not provide Police Certificates for any alias that is not on the Passport (Aliases are not allowed on Passports)

The rule goes something like "ONE Police Clearance PER LEGAL NAME on Passport"

How do I approach this with the NVC ?

Anybody here have any experience with this ?

I have decided that waiting for "case complete" or (god forbid) checklists...is a worse wait than the 8 month USCIS wait I had. :-( At least when I was waiting in that stage I kept busy by reading the NVC forums and getting things organized for the next step. Now that everything is submitted I don't know what to do with myself! Its only been a week since everything was received and it feels like 20 days!

This will be the longest 30 days of my life I think. The only good thing is that there are no more federal holidays to contend with until May and hopefully we will be approved long before then...now I just pray the weather starts cooperating! :-/
