eh - you missed one important bit [apologies if someone else wrote this already]

Getting an ITIN MOSTLY is done when filing a tax return.

So, prep the tax return, print to paper, you two sign it,

prep the w-7 document with the ID stuff (pay attention to that one, lots of ppl are bit by wrong ID)

sign the w-7

and

the two of you prep a cover letting stating that you elect to be treated as a resident alien tax purposes for tax year 2013 (and sign it, both of you)

then

send all to the W-7 intake address in Austin TX, listed in the W-7 instructions.

you will not 'wait for ITIN' then file the return, you file all together into the special IRS address in Austin TX.

DURING TAX SEASON, it's 6 to 10 weeks on turn-around, expecting a paper-check as well.

MAKE 2 COPIES OF EVERYTHING YOU PREP for the tax return, submit ONE with the I-864 and SHOW the 2nd one on interview day (or both).

My husband is filing as MFS so just to clarify, I need to provide him with an authenticated copy of my passport biographic page authenticated by USEM, signed w-7s and a cover letter... is there anything else I'm missing?

Oh and I assume that the stuff about me on his w-7 should be consistent with the information on my passport. The problem is, I still have my maiden name on my passport. Should he use that or my maiden name?

Confusing.

MFS? Not need to do any of what I wrote.

MFj ? Need to do all of what I wrote.

Sure, one letter makes the difference here, S versus j .

THE BAHAMAS - PORT OF ENTRY

APRIL 10,2014 "HOME SWEET HOME" with hubby

hi saylin,

i am filling out the i-864ez and was wondering about the household's size question.

should i enter zero from 16 B to E since 16A already included me and my wife,

and 16F, add together lines a,b,c,d and e and enter the number here. should i enter 2 or 02?

i know it sound silly but i have no idea how picky can NVC be when sending out those RFE

If there are no such persons, then yes, put 0 for 16b through e. And if that's the case, then yes, 16f is 2. Since there's two blocks, put 02, so they're both filled in. Same thing for b-e, put 00.

Any Aussies from either NSW or QLD out there? When I go to the Police Certificate site for Queensland, it says that the police report is delivered directly to the US Consulate. Therefore, my spouse will not be able to turn it in with her IV documents. May I assume that NVC will know this, and not hold us up waiting for a police certificate that will never be sent to NVC?

The Australian Federal Police site says both NSW and QLD send directly to the US Consulate in Sydney. Guess that means we have to get our NVC number so that it can be married up at the Consulate, right?

Who has gone through this?

Thanks!

Sukie

And would I need to fill up my own w-7 or just sign the one he prepared?

Is it possible to just print out a blank w-7 (or whatever document it is he's supposed to fill up for submission) and send to him to fill up instead of him mailing me what he has and mailing it back? Or there annotations or stamps or whatever that's already there that he'll need when filing?

And do I authenticate a copy of my passport or US tourist visa? Please don't say both because that would cost $100 :(((((

you should study the w-7 form from the IRS website, and note the 1040 requires your signature.

so, for shipping stuff, you can ship to him:

[downloadabe forms]

1. 1040

2. w-7

[stuff from embassy]

3. passport authentication stuff

[stuff for you two]

4. letter requiring both of your signatures.

if you cannot navigate the irs website to get the forms downloaded,

tell that man of yours to send you a blank w-7 and blank 1040 via email,

then you two go over those forms together when you have time.

i suggest, ask your husband to tell his tax preparer all the documents you need to sign. it will be much easier. my husband does that. we went thru this ITIN stuff, he sends me all the documents needing my signature, fedex it back INCLUDING my passport, he showed it to H&R block preparer and thats it. got my ITIN and a few weeks later his refund.

I'm reading through the W-7 instructions and it says that if I'm submitting my passport then there's no other documents needed to prove my foreign status but that I also need to include visa pages. Does the visa page have to be authenticated too?

Or can I just submit a single page that contains a copy of both my passport and visa on the same page? Not sure if you can picture what I'm saying lol....

bio page of passport is sufficient for this.

w-7 form also used for folk INSIDE the USA, so IRS will want their VISA stamps also.

Since you are outside of the USA, IMO these visa stamps are not required.

Thanks a bunch, Darnell! So helpful, as always.

Last questions (hopefully)...

I'm looking at the form and it asks for "Type of US Visa (if any)", do we need to mention my tourist visa even if we're not including a copy of it?

The instructions also state

The “Entry date in United States” must contain the
complete date on which you entered the country for the
purpose for which you are requesting an ITIN

(if applicable). If you have never entered the United States, enter “Never entered the United States” on this line

I was only a tourist when I went to the US, do I still mention my date of entry?

Does this even matter when I'm only filing with my husband?
