Timeline

Hi everyone - we are finally able to fill out the DS-260 today, and have come up against a question.

In the "Miscellaneous" section, there is this question:

Are you a former exchange visitor (J) who has not yet fulfilled the two-year foreign residence requirement?

Husband was originally in the US on a J-1 Visa, but it says right on his Visa paperwork from that, that the 2-year residency requirement does not apply. So do we answer NO because the requirement doesn't apply; or do we answer YES because it's less than 2 years, and then explain the situation at the interview?

22 Jan 2014 - Received Case # and IIN from NVC - we're in the system!

21 Mar 2014 - CASE COMPLETE!! (received info by calling NVC on 24 March)

ROUND 2: I-751 process - just getting started!

18 Apr 2016 - I-751 packet sent to California Service Center

28 Apr 2016 - money order cashed

02 May 2016 - NOA1 received - phew!

16 May 2016 - biometrics appt

I knew i would get a case complete this week. Because NVC always took 3 weeks to review everything i sent them. (about 13 business days)

I am going to include the "in transit" in my list of 5 last entries.

Those are really "entries" in the US, no matter how long we stayed in the country, right?

Yeah, I would consider them entries, even though they were really short.

Ohh, I understand what you're saying now. Um, off the top of my head, I can't recall any optional questions. But, if there are, it will state so once you go through the form itself.

Hmm. I would put no, and if there's an explanation box that pops up, write in saying it doesn't apply. If not, just explain it at the interview (if it comes up).

And thanks for the concern! Ended up being my car battery (it's about 5 years old and apparently they're only good for 3-4 years). I've had major car problems this past week (wouldn't start like 4 times throughout the week). New battery was put in (for a lovely $123) and sounds a lot better :) Thankfully we should be getting our tax refund back soon, so that'll pay off that, along with my flight back to Canada soon.

I had put $0.0 as my income (because im a full time student without a job).

I forgot to include a letter explaining why my income was $0.0.

Thats all.

If you have a lawyer, NVC automatically assigns him/her as your agent, thats why theres no more need to fill out ds261 :)

Now, will we still be able to give NVC our emails? I'd like that at least one of us, my husband or I, could also receive the emails.

Is it necessary to call them up again and confirm case complete? even though the lady clearly said "you have a case complete sir"

Thought I'd ask directly just in case you missed my earlier Q as I didn't quote you.

My wife is a bit worried we will get a checklist for our AOS.

Reason is the I-864 shows income to the penny but it is rounded to the dollar on the tax return. Is this discrepancy likely to flag a checklist or is this normal?

Yes, you should still be able to give over both email addresses, then everyone should receive the email (as far as I know).

We used the numbers from the tax transcript as that's actual proof the tax return was sent in and specifically that the IRS accepted the return, making any adjustments as necessary. And, as far as I know, NVC wants EXACT amounts, right down to the penny, and no rounding up.

So, my two questions for you:

-did you round up?

-did you send in the tax returns or tax transcripts?
