Hello,

sorry if this has been asked before, but my quesiton on filing 2013 taxes for AOS. My wife and I married before 90 day period but didn't apply for social security. How do I file tax, married filing separatly or married filing jointly, and do I put NRA under social security number? She has no income what so ever.

Were you married by Dec 31, 2013?

Can you get her SSN before April?

Have you filed AOS yet?

yes married before Dec 31, 2013... we filed for AOS but it was denied due to a tax error... AOS was filed back in September and I made mistake and sent 2011 taxes instead of 2012 (yes big mistake and learned to double check paper work before mailing it). We just got a denial letter but have 30 days to reopen. Now I was going to send 2013 taxes... or should I sent 2012.

Regarding SSN, how can the office issue her ssn#?

btw this is for my brother...

check the I-94.

If today is under 76 days of the issuance date, she can apply in person at SSA office, today.

if it's past 90 days, she would need an EAD to use to apply for SSN at SSA office.

EAD application fees are waived when filed with the I-485 for ad(ustment of status.

as to the tax question, sorry, resident alien with out a tax number, i not know what to tell you. maybe ITIN chasing is useful?

You won't be able to get a SSN now with a denied AOS, so I would look into getting an ITIN.

2/06/13: APPROVED!
