I have read about several people expediting their EAD when they are adjusting from a status that doesn't allow them to work when they have a pending job offer but I haven't seen any cases where someone's current work authorization is going to expire forcing them to take an unpaid leave of absence until they receive the EAD. Due to procrastination and some difficulty getting some of the supporting paperwork (all entirely my fault so this isn't a pity party) my current E-3 visa is going to expire about 6 weeks into the AOS process, I'm hopeful it miraculously gets issued in time although I know that is very slim so I was wondering if it was worthwhile trying to expedite it?

I'm fully prepared to take the unpaid leave of absence but of course I would like to avoid that if at all possible.

I would try. Interrupting work is a stronger case for it than a pending job offer.

Thanks, I'll give them a call once I'm out of this training session at work and will update here how it goes.

Update: Seeing how I couldn't call at the time I dug up the Privacy Act Release Form for our congresswoman and made a plea for the EAD to be expedited via fax, I will see if that goes anywhere and if not I will call on Monday.

You can request expedite directly from USCIS. No need to go through a congressperson. You aren't her constituent anyway, so it'd be on behalf of your spouse...

I know but I was stuck on a computer in a training room and my searches were revealing that appealing to a congressperson had a much higher rate of success even when it was the beneficiary making the request and not the USC sponsor so I filled out the form, pasted in my signature and faxed it online, which I could do without interrupting the training so I had nothing to lose.

hint: talking with an ISO about this will get the ISO to give you either

--a super secret squirrel email address to submit the expedite letter to or

--a super secret squirrel fax # to submit the expedite letter to.

Sorry yer not available to use a phone in yer training session.

It's not like work was gonna interfere with chasing an expedite to be allowed to work faster....ohmy.png
