Hello From The Netherlands and USA

Hello, Just a few words and a question or two from us here in Holland . I met my man online in 2009 after several trips back and fourth across the ocean in 2011 I moved to Holland to live with my fiancee . My fiancee is a software engineer and has a good job here in Holland so he was easliy able to sponsor me for a residence permit and Visa .Our plan was for us to both move back to the USA withing two years...but that did not happen because he owns his home here and we were waiting a bit hoping for home sales to raise so that he doesn't take a loss . In the mean time we got married here in Holland over a year ago ...we are soul mates and best friends .

It is now 2014 and I ned to move back to the sates,my grandkids are growing and I am unable to acclimate here where we live in Fiesland .I have no friends, no job and suffer PTSD from a long previous marriage of abuse .Long story short my inability to make social contacts etc forces me back to the states sooner rather than later .We have been trying to get his company to transfer him to the states where they have a office but we are chasing our tails. It is email after email of being bounced around from India to the States and being fed the same info we already have about immigration procedures .His company wants him to have a work permit before they offer him job .

I am going back to the states to set up an apartment for us...but we had planned on doing this together and never having to say goodbye at airports again .I discovered somthing called DIRECT File ? Turns out that Amsterdam does not do that any longer ?I have read that Germany Field Office now has jurisdiction over The Netherlands immigration .I read also that you have to be a resident of Germany to direct file at their office Does anyone know if you can direct file there even if you are a Resident of Netherlands ? We were really wanting to direct file in Amsterdam or Germany too shorten our immigration process and get his work permit .The phone numbers for the Germany office on the website arent working .I just dont know what to do anymore and my stress level is off the scale and affecting my health. Please if anyone know what we should do ...please help me with some answers.I cannot keep flying 10 hours plus back and forth for a year of longer because I have had Pulmonary Embolisms and have to fly with blood thinners and it is still not safe for me .He cant just quit his job with another lined up and loose the dutch house etc .Thank you so much for reading this far .

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Aangenaam om je kennis te maken. I was in a similar situation to you guys. I wound up coming here ahead of my husband because there was no way for him to immigrate here at the same time as me. It'll be over a year by the time he gets his visa. I'm sorry. I know this isn't good news for you. But that's really the only way to do it.

And I can totally relate to the isolation, I lived in Limburg. Friesland is no better from what I understand.

Edit: Actually, I'm wrong. You can file from abroad as long as you can prove that you intend to re-establish your domicile in the US. I don't know if anyone has had luck doing that in NL though.

Right. The Netherlands no longer has a field office, but Germany does.

To file direct with Germany you would have to be a resident there: http://germany.usembassy.gov/visa/uscis/i130/

So... You'll be filing via Chicago lockbox. You can do that while abroad, but as Kaylara says, you'll need to meet the domicile requirements. See the form I-864 and accompanying instruction PDF for more on that.

Thank you for the replies . Does anyone know if we can file in Amsterdam the I-130 ? Is is mandatory to file papers here in the Netherlands because we were married here ?Thank you :-)

You can file *from* Amsterdam. You'll mail your petition to the Chicago lockbox. You can file from wherever you live.

Where you married is irrelevant.
