My family and I have been recommended for a 212d3 waiver after an interview with a consular officer at the sydney consulate. We now have to wait up to 6 months for the final decision.

How likely is it to be approved? I have read that once a CO recommends a waiver, it is granted in all but the most unusual of circumstances. Is this accurate?

Thank you.

212d is a nonimmigrant waiver, so I would guess a tourist visa.

That is correct. We have applied for a tourist visa (B2).

We need a waiver because we have a misrepresentation charge against us from 2011 when we applied for an E2 visa.

My parents reside in the US and cannot travel due to health reasons, so we need to travel to them if we want to see them. That is the reason we wish to travel to the US.

Thank you.

It might, the CO don't have final say, but it was a good rec. for

someone with prior issues and a medical emergency, additional plus

is your are from a country on par or somewhat better at times than the US

In regards to living, economic & being a 1st world country
