Hi,

My mom is sponsoring my fiance, I do not make enough to sponsor him but do I still have to submit the affidavit of support myself? If so, do I have to send anything along with it? I never really filed taxes as I never made enough money to have to do so.

Yes, send in the same things has your mom does. You are the primary sponsor as you are the petitioner and your mom is the join sponsor.

The embassy in London only really want to see that your fiance will be supported and ok for the first 90 days. However, I would advise getting all the documents (as per the notes for the I-864 affidavit of support for the Adjustment of Status) since you will have to anyway when you come to adj the status.

It also can't hurt to have as much as possible in terms of evidence. What you and your mom will need to send to your fiance is:

- Letter from employer - With dates employed from, nature of employment, Permanent or temporary, How much the pay is and how many hours contracted per week.

- Letter from bank - Dates the account was open, current balance, how much was deposited in the past 12 months.

- Last years Tax return (you will need the past 3 years tax returns for the AOS)

London embassy only really look at the I-134 that you and your mom will each will out respectively and they will need the last year's tax return from your mom. Everything else is just a bonus but once again, is required for the AOS so you might as well get it now.

These also need to be ORIGINAL documents (a part from the tax return) the I-134 is the most important that needs to be an original as you will have to sign yours and your mom will have to sign hers. They will not accept copies/faxes/scans.

So gather all the info and mail it to him :)

Yes, everything I said above, plus the fact that you fill out I-864 affidavit of support and your mom will need to fill out I-864a which is for joint/co-sponsors.

All that evidence I mentioned is required and the last 3 years tax returns will be required from your mom too. As for you, you can only give them what you have... If you don't have any tax returns then you can't give them. But the letter from the employer and bank etc... you can do. Even if there isn't much. My now wife only had like $130 in her account when she had her letters printed as she was about to get paid the next day. So it doesn't matter how big or small the figures are, as long as your mom meets the income requirements.

I am assuming she does? If not, they can be met via assets but the process is slightly different for that...

Make sure you fill out the EAD work auth. form (I-765) and the Advance Parole Travel document (I-131) with the AOS (I-485) and the Affidavit of supports (I-864/I864a)

Because it is free to file them if you do it as a whole packet. You will need to pay to file the EAD and AP if you file them separately. The AP is only if your fiance plans to leave the country for a little bit during the AOS period. So it is optional.

And sorry, not to overload you with information... but 10days - 2 weeks after he has arrived, you should file the Social Security application. There is a short window in which you can do this before doing your Adj of status.

You have to fill out an I-864, even if you make $0. Read the instructions for the form, page 6. It explains toward the bottom what to do if you haven't filed tax returns. Proving your low income isn't so necessary because you already know you don't qualify. If you make any income, you might want to include some pay stubs to show you do have the job you state and make some money.

Mom also does an I -864. That same page 6 tells only one tax return or transcript has to be mailed in. Read it carefully for the details. She can choose another proof of her income like an employer letter or pay stubs to further show she is currently employed. And she has to include proof she is an American citizen or permanent resident.
