I received an Initial Request for evidence in regards to I-864, but my husband makes more money now and we are planning to use his current income, which is way above the poverty guidelines. Do you think that it is a good idea to use our current tax return(2013) and last year's abnk statements to reply the RFE or should we still seek a joint sponsor?

We submitted pay stubs, employer letter, tax return from the last three years.

Below is the excerpt from the RFE letter:

Based on the documents submitted with the form I-864, Affidavit of support, for the petitioner/sponsor, the income did not meet 125% of federal poverty line for the petitioner/sponsor's household size:

Submit evidence of assets that meet the standards listed below or obtain a joint sponsor.

Such evidences includes:

  • Bank statements covering the last 12 months
  • Evidence of ownership and value of stocks, bonds, and certificate of deposit;
  • Evidence of ownership and value/equity of the other personal property and dates acquired;
  • Evidence of ownership, a recent licensed appraisal or county tax assessment and any mortgage/ lien or lien release of any real estate.

Submit a letter of employment which indicates his current individual annual income, add some pay stubs, the tax returns of the previous years and you should be fine. From the RFE, they want you to prove that he has means beyond the federal poverty threshold. Since his new job pays him more money over the threshold, you can use pay stubs from that job and an employment letter to back it up.
