Which form for J Waiver? DoS or USCIS?

Recommended Posts

There are two forms for J1 Waiver. One which is available online on the DoS website with a processing fee of $215. https://j1visawaiver...tion.state.gov/


The other one is a PDF form on USCIS website and the processing fee is $ 585 : http://www.uscis.gov.../form/i-612.pdf



Which one of the forms do I need to fill in for J waiver?

Are you filing J1 waiver based on No Objection statement or Exceptional hardship?

A: Apply directly to the USCIS on Form I-612. Also apply to the Department of State on Form DS-3035.

I don't see I-612 form being listed to qualify for fee waiver

Maybe your boss could help you pay the filing fees.

Merry tooth, do you know if a person should try for a No objection statement before trying other means?

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

From what I have researched online, there are 5 Bases for Recommendation of a J1 Waiver:

1. No Objection Statement
2. Request by an Interested U.S. Federal Government Agency
3. Persecution
4. Exceptional Hardship to a U.S. citizen (or lawful permanent resident) spouse or child of an exchange visitor:
5. Request by a designated State Public Health Department or its equivalent (Conrad State 30 Program)
You could choose any one basis that you best qualify for or applies to your situation, not necessary to try for no objection statement first.
e.g the J-1 physicians will file the waiver based on Request by an Interested U.S. Federal Government Agency.
They may not use the home country government's lack of objection as a basis for granting the waiver.

So, my I-94 was held by the IO during my AoS interview. Here's what it says on the filing instructions for waiver:

4. If you are in the United States, you must submit your original temporary entry permit (Form I-94, Arrival- Departure Record) and the original entry permit of your spouse, if he or she is in the United States and not a U.S. citizen or lawful permanent resident. If the entry permit is attached to the passport, remove and submit it for this purpose. Do not submit the passport.

What do I do instead?

One quick question. Can I go on domestic travels without I-94 card since it's been held at my AoS interview by AoS? I am planning on attending a conference around the beginning of March in California. No problem with national air travels on the account of i-94 not being present?

You only need your driver license or state id card for domestic travels.
