Does I-485 always need interview ?

Hello everybody,

I sent my packet (I-130, I-131, I-485, I-765) to Chicago Lock box which went to NBC. My receipts have MSC code at the beginning. It was Dec 3 / 2013 the file is in process. They scheduled my bio-metrics on January 8/2014. I did it by early walk-in on December 21/2013.

I got the first case status change of my I-485 application on 31st December/2013. It says now 'Testing and Interview'....

Then no more update. Remaining others are still frozen in 'Initial Review'.

My father-in-law told me that might be I won't need an interview. They are gonna send my Green Card directly, and the interview will be after 2 yrs when condition removal will be necessary.

Is it true ?

I feel his logic is correct.

If the interview is taken right now , so the USCIS got confirmed that the marriage is done on good faith, it is legitimate. So they should approve 10 yrs Green Card.

Am I wrong ?

And one more interesting issue- while I check my case status logging in my USCIS portfolio, everything is unchanged.

Last Updated one is my I-485 on 12/31/2013 which tops the list on that column.

But when I click on the column title (Last Updated mm/dd/yyyy) , it shuffles. It shows I-130 tops the list, right below is my I-765 though the dates are unchanged along with case status.

Can any body share his/ her experience please ?

There is a 50/50 random chance to have an interview or not, for those adjusting from a K-1.

Everyone else will definitely have an interview.

I sent my AOS in april 4th 2013 ,got rfe1 in September because we forgot to sent the vaccination records ,rfe #2 in January 4th 2014 ,had to make medical examination and in 27 January 2014 we got home a welcome in usa mail telling us that we where approved and I will got my green card home in 3 weeks.Today I checked the mail and my green card was there .So I got mine without any interview .good luck to everybody!

You are AOS from K1, so you got your green card without interview.

OP is filling I-130, I-131, I-485, I-765, so I doubt he/she is AOS from K1.

You are right Merrytooth.

I am adjusting from F-1 status. (Came here as an international student).

But can you give me some idea please ? if I am not even receiving any approval online of my EAD card though it reaches almost 90 day limit, what should I do ?

I have to give some joining date to my company HR as a reply to their offer.

Many are saying about I-551 stamping.

But is it possible to get in an Info-pass appointment ?

As I know Info-Pass does not give any instant approval like that.

I-551 stamping is for those who have already been approved for the green card but yet to receive the physical green card.

You might want to make infopass appointment to request expedite of your EAD.

Bring your job offer letter to explain the importance of the job to you
