Hello All

I'm knew to this site as far as posting comments. I've visited often to get information regarding my case. I'm a USC sponsoring my husband who is an Egyptian citizen. He is currently adjusting from a B2 visa. We filed our paperwork December 13, 2013. At the time I made the AWEFUL mistake of putting his second middle name in the last name section of the application. I did this because I completed the forms online and ran out of room in the middle name section. I thought the would pick up the very last name as his last name but instead the used BOTH names as his last name.....my mistake:-( Anyway I didn't notice the error until we received his biometric letter. We went ahead and did the biometrics with the incorrect name and decided to change it later by calling USIC. I was afraid the information would be lost if we tried to do it at the biometric center.

The biometrics was done December 31 and I called January 2 to request a correction to his name and I informed them we did his biometric on the 31st. At the time I asked the customer service representative if she needed all three receipt numbers...I-130, I-465, and I-765. She told me NO it's all one case and they well make the correction on all the forms. The case number I gave her was for the I-130.

So I called them today to get an update because we hadn't heard anything back yet regarding the name correction. The Rep I spoke with informed me they need ALL THREE case numbers because each case is on a different path. He also told me my husband would have to make the request for the other two case numbers since they are associated with the applicant. He told me they need his permission for those two. I am so disgusted and angry right now. I've gotten two different answers from two different Reps.

Which answer is the correct one? Does anyone else have experience with name corrections? I plan to call them again tomorrow with my husband. I'm worried because they may be close to issuing his EAD with the incorrect name since it take sooooo long for them to make corrections.

By the way the Rep also informed me NBC is currently running 30 days behind because the office is getting slammed and to call back in another two weeks to get an update :-( He said my service request hasn't even been assigned to anyone yet. So frustratedsad.png

Did you talk to a tier 2 or the first person to answer the phone? There is a reason the USCIS call center line is called the "misinformation line." If he is adjusting you can change his name on the I-130 (as it's your petition) but he needs to change his name in the I-485 and the AP/EAD (the form numbers elude me at the moment.)

I spoke with the first person who answered the phone. She sounded knowledgeable and confident in what she was saying so I didn't think anything of it. I hung up the phone thinking everything was good to go. I wish someone else answered the phone and gave the correct info so that the request could have been put in for all three forms 30 days ago mad.gif.

We haven't received any notification regarding the EAD yet, currently in "initial review". The I-485 is currently in "testing and interview". I'm hoping they check to see if there are any service requests before the issue the EAD.

Never talk to the first person who answers. Always ask for a tier 2 (an ISO: immigration services officer.) I would do this ASAP and not wait for anything service requests to meet their ears from the CSR.

They can only talk about the I-130 with you, so your husband will have to be on the line to discuss the other applications.

Try to get a Tier 2 person.

This type of thing is hard to correct. Sorry, it was a bad mistake.

@Harpa.....Why is it hard to correct?? The first Rep informed they can just go into the system and correct it. I know she gave me bad information about the other stuff but I was hoping she was at least correct that it was an easy fix.

Will the Tier 2 be able to correct the info on the spot? Or will it still have to wait in queue for it to be assigned to someone at NBC?

I hope it's easy to get a Tier 2 on the phonecray5ol.gif

Because his name is wrong, so they will have to redo all the files, redo all the background checks, lots of things. The main thing in his file is wrong. His name.

I don't know exactly what they do behind the scenes but I have seen name change request while the case is pending fail often. You should bring this up at your interview, but that should be after the EAD is issued.

If I don't have any success tomorrow with a Tier 2, I plan to make an infopass appointment to get it done. His name is correct on his Visa and Passport. We're still somewhat early in the process...about a month and a half. I hope that plays to our favor.

We're not worried too much about a delay as long as it's not too long. We just want the information corrected. We hope it's correct before the EAD is issued so there are no issue.

Worst case, we'll have to deal with it at the interview.

Another reason why I was concerned it's changed before the EAD, I believe he can get a SSC and driver's license once he get the EAD. I'm assuming they will use the Work Permit as verification of his name and want to put that info on the SSC and driver's license.

Correct me if I'm wrong. I have bits and pieces of information.

UPDATE:

For all the interested minds. My husband and I called today to put in the request for the name correction for the I-485 and I-765. I was told to call back in two weeks if we haven't heard anything. I was also told to call back Monday regarding the service request for the I-130 since the 30 day mark isn't official until tomorrow....they get 15 to 30 days to do corrections.

I asked about the impact of the name of correction on the biometrics and was told there is NO impact....in other words no need to re-investigate his background. I was also given this information previously but decided to double check it.

A name correction isn't a difficult thing to correct, it simply can take a long time if the office where your file is located is backed up with service requests. NBC is currently running behind so I'll have to stay on top of this issue.

LESSON LEARNED:

I was told the first CSR I spoke with was probably new. I did notice when I spoke with her she was reading from a script and seemed afraid to deviate from it. If you call and get someone who is afraid to deviate from the script in front of them, it's better to hang up and call again to get someone more knowledgeable or ask for a Tier 2.

I also did a service request to fix the last name and it was easy... done in 30 days. Glad it worked out!

Just when you think a matter is resolved.....it isn'tcray5ol.gif I was told to call back today because my service request for the I-130 reached the 30 day mark Saturday. I called USCIS to get a status update and put in a new request if necessary. Well, the CSR informs me since the error was made on the application we filed we need to mail a letter to the NBC in order to get the corrections made and that's the reason why I haven't heard anything back yet. And that I shouldn't have done any service requests....arrrrrrggggghhhhhranting33va.gif As you can imagine I am seriously fuming.

Last week I was told I hadn't heard anything because the NBC was backlogged....now this!!! As stated earlier we put in the service requests for the I-765 and I-485 last week becoz of bad information. Information that now looks like ALL OF IT HAS BEEN WRONG.

I got an email this morning stating our I-485 has been scheduled for interview March 11. File was accepted December 18th, went faster than we thought. Happy about that partkicking.gif

Anyway, I called back after I spoke with the CSR and explain to the next rep that answered what happened as far as getting three different answers and she escalated the call to a Tier 2. When the call transferred I was told it would be 132 minutes before a Tier 2 answer the phone!ranting33va.gif I decided not to request a call back becoz I read some people never get the call back. I am now 50 minutes into waiting for someone to answer....aaarrrgggghhhh!!

Can someone please please help me again? Should I have mailed a letter to correct the name situation to NBC?? I think the file is now being transferred since it has been scheduled for interview. I asked the CSR about that who claimed they would communicate with the local office. I DON'T TRUST THOSE CSR'S AT ALL!

Just spent 2hrs and 37min waiting for a Tier 2 to answer the phone....finally just gave up!ranting33va.gif I called back and gave the whole spill once again to a CSR and asked her if a supervisor was nearby that I could talk to or she could talk to and give me a definitive answer for this situation. She transferred me to a Supervisor who informed me the I DID NOT need to submit a letter and apologized for all the conflicting information I have gottensad.png. She said the service request was the only thing I need to do and just wait for them to contact me if they need anything from me.

If you have trouble getting through to a Tier 2 ask to speak with a supervisor, they don't see as much as a Tier 2 would but they may be able to clarify misinformation a CSR has given.

This process is stressful enough the last thing we need to deal with are a bunch of misinformed CSR's!

If the SR doesn't work, I think we'll just correct it at the interview since it's next month. He might not even get a Work Permit since the whole process is taking 3 months for us.
