Help! Do I need to use SSN ( valid for work only with DHS authorization ) on tax forms and I am already out of school

Hi

I have got SSN which says only valid for work with DHS authorization. I already went out of school. Now I am planning to file adjustment of status through marriage. Can I assume I don't have SSN or I have SSN ?

My first question is

My husband and I are going to file the tax return by using NRA on spouse's SSN line and in the explanation of changes we were going to say " I don't have SSN "and we are also planning to file 2013 tax by using NRA too. Would that be fine if we use NRA in my SSN line since the SSN I got from school is valid for work only with DHS authorization plus I am already out of school ? This SSN probably won't be valid anymore and I am too scared to fill this SSN on other things too.

My second question is

Will USCIS think I am lying if I fill " I don't have SSN on amended tax return for 2012 "which I need to send with AOS application or will they understand this SSN is only for working in school and I am aldy out of school .

Also Do I need to enter this SSN number on the I- 130 , biographic information form

I am too confused , can somebody help me ?

We are about to amend our tax return by using NRA and this question popped up in my mind.

An SSN is yours forever. They do not expire. You do not just get a new one each time you need one. You will change your status with the SSA, but your number will remain the same. If a form asks for your SSN, then you provide it.

The "Valid for Work Only with DHA Authorization" will be removed when your AOS is complete. You will have to show SSA your GC and they will send you a new card with the same number. As Jay-Kay said, your SSN is yours for life. I would use your SSN on your tax forms.

What I thought was I was not allowed to use this SSN for any reason when I am out of status. I wanted to avoid problems about my school or Social security office informing immigration office for using this SSN.

I am out of status and that is making me worry a lot about using this SSN. It says on the social security card that if you use it to work , we will inform immigration office. I was also afraid that I will be informed to immigration office if I used it for tax return. Why do IRS need SSN ? If they are going to check my SSN, will they know about me being out of status or anything like that ? Will they still check this SSN if I filed MFS instead of MFJ on tax return ?

The main problem is I am out of status and I am too afraid to use this SSN because it says on the social security card that If you use this SSN to work, we will inform immigration office "

What if I file tax by using NRA , will I have problems with USCIS for doing that when I file AOS application ?

and also what if I don't enter my SSN on G 325 A form ? Do I have to ?

You will not be using it to gain employment.

You list the SSN on your taxes and all your AOS forms where it asks. When you receive your EAD after filing AOS, then go to the SSA and update your status with them. When you do that, your current status will be 'attached' to your SSN. That is all you need to do. You do not need to worry about listing your SSN on forms because you are out of status. Once the AOS is filed, you will be in a period of authorized stay.

IRS will not be checking your status that I am aware of. And even if they did, so what? You are married to a USC and will be applying for AOS. Your overstay will not be an issue for immigration and will not be an issue at all to list your SSN on your tax form. You must list the SSN and file the taxes. You should also list it on all your AOS forms where it asks for it. This is a non-issue that you are worrying needlessly over. You are going to overload on stress if you keep that up. Try and relax a bit. Answer the questions on all forms honestly, and that is it.

I just thought that this SSN was issued to work on campus and I don't have to use it for any other reason. That was my wrong thinking.

We even filed our 2012 return as single, just because I thought I can't use this SSN at all.

I guess I will just use that for 2013 return and amending 2012 return too.

If I have SSN , tax returns have to be MFJ for USCIS to prove the marriage is bonafide ? Or it can be either MFJ or MFS ?
