AP - traveling back to Country of Origin for wedding ceremony

My fiancee will be coming to the U.S. in hopefully Mid February (still waiting for the embassy to issue the actual visa - interview was 1 week ago). We plan on getting married (legal paperwork) right away and then filing filing for the adjustment of Status, Advanced Parole, and EAD (she doesn't really need to work - but I guess we might as well apply for it at the same time). We then want to travel back to China to have the wedding ceremony sometime in May.

Her family wants to start booking wedding reception venues in China right away (which requires a hefty deposit). Before her family pays the booking deposit. I would like to confirm 2 things:

1) Is there any possibility that USCIS may deny the Advance Parole travel permit?

2) How long does it normally take to process the AP document? Any situation where it may take longer than May?

Filed: Country: Vietnam (no flag)
Timeline

It will take 2-3 months for AP after you marry and file for the AOS.

A party is not an excuse to expedite AP.

You are taking a bad risk IMHO to schedule a party in China within 2 and a half months after she enters.

Push it back to June or July.

You are playing with fire and may loose those hefty deposits as you do not even have the visa for her to come to the US yet. What happens if it is delayed until April? IMHO, I would wait until she actually has the K-1 visa and you have made travel plans for her to arrive in the US. You might also look at the time it takes to get the Marriage Certificate back for the recording county and to be able to get copies. Some require several weeks--I would make a regular photo copy to send into the USCIS before filing it with the county if that is the case. For us, I was able to walk out the day of our marriage with 6 certified copies and the original was mailed to me and received 3 days later. Then there is the processing time for the AP which can very.

To answer your specific questions: 1) no, AP is not usually denied, 2) it appears to be taking about 40-90 days for AP/EAD. so you could miss the window if your visa application takes longer than mid-March. As is always recommended here on VJ, never book or plan anything with a specific date unless the proper documentation is in hand as there can always be delays.

What is wrong with July or August? Why must it be May?

Good luck,

Dave
