Hi Everyone,

Im new here. I recently filed my I-360 on the 4th June. Im using catholic legal charities to help with my case. Long story short, when i married my husband, he was determined to get only a religious wedding, (hes a muslim) which i was ok with as i thought legal and religious marriage certificates are the same. Soon after, he stopped me from going back to school, refused to get medical insurance for us (i have a severely disabled child), stopped letting me go out, became lazy and stopped showing up for work. He assumed my parents would continue to send me money and we could live off of that, became very aggressive, violent and abused both me and my child emotionally, physically and mentally. It got to the point where i developed an eating disorder and lost 45lbs in the first three and half months of marriage.

He would demand sexual things and became irate when id refuse. Anyway, one weekend while he was busy, i pushed my daughter (10 years old in a stroller) to a local Dennys, which we used to frequent, and just sat there crying. The manager overheard me on the phone to a friend from England complaining and gave me the card with national domestic violence hot line number. I called and they got me in touch with a DV shelter. 6 months later, the shelter says ive overstayed and need to start thinking about where i need to go. Luckily id been saving money and found a one bed apartment.

Ive recently found out that in a bid to win me back, my husband actually recorded our marriage with the courts and dated it ten days before i left him. I filed a copy of it with the injunction that was granted along with photos and statements with the I-360.

My questions are: how am i expected to support myself and my child trough this process. My parents send me enough just to cover rent and medical insurance for my daughter which $343 per month and rent at 700?

My attorney says that once and only once my vawa is approved will she file for work permit along with green card. Is this the norm?

Is it advisable to apply for disability for my daughter once and if i get the prima facie until i can work and support ourselves?

Hope to hear from someone soon. Very tired and overwhelmed.

milania86. If you got the prima facie your daughter can use medicaid(free care).Use the prima facie to apply for medicaid for your daughter , she is a derivative of your vawa aplication.

you can file I-765 ANYTIME you want, bur then you have to file i_485 as well. Keep in mind that if your I-485 is denied you will be removed from the United States, but if you just filed Vawa, and they deny the case they are not removing from the US Vawa filers now. Talk with your lawyer about that, you can file work permit anytime you want.

Make sure your marriage is valid. We had here in the visa journey one girl that had a Muslim ceremony, and the marriage was registered two years later, her case was denied, because USCIS did not consider her marriage valid.

Hi Sandra.

My Attorney said, my marriage is valid, however, they may question why we had the religious one Aug 14th and then the civil wasnt done until October, also that i left him 10 days later.

We havent received prima facie yet, but its good to know about the medicaid.

I think the reason she doesnt want to file my work perfit app and i-485 is as you said, the removal proceedings are harsher.

Im just so desperate, just like everyone else i guess so just sort this mess out and move on with my life.

Milania with prima facie you can apply for food stamp and Medicaid. Many offices have no clue about prima facie and deny Medicaid and food stamp. Search in the Google something regarding Medicaid and primal facie in Florida and take with you when you apply to obtain public benefits,in case they don't want to aprove Medicaid and food stamp.

Do you have a police report?if yes then check in your County about "relocation payment for victims of domestic violence". All States have one payment of $1.500 for victims of domestic violence, but you must have a police report to apply for the relocation payment
