Vawa unit until Last October was taking 14/19months to adjudicate a Vawa case, but they hired over 100 immigration officers, now it's taking 3/4 months, despite i have a few cases adjudicated in 60 days after December 2013.

quick question sandra, if i file only the i360 without the AOS, do i get a document that allows me work? Or how does this work?

No you don't; that's one of the downsides of filing an I-360 by itself.

There isn't really a best way; each has their pros and cons.

If you concurrently file an I-360 and an I-485 then (pro) you can also file for employment authorisation, which will allow you to work until the I-485 is adjudicated, but if your I-485 is denied then you are usually placed in removal proceedings (con).

If you standalone file an I-360 first you cannot obtain employment authorisation (con) but, if the I-360 is denied for any reason then you are not usually placed in removal proceedings (pro).

mamaof3 you won't get work permit now, since you chose not to submit form I-485 and I-765. It's up to you to decide if this is the best way or not, some people cannot afford to wait Vawa approval to start working.

Hi Sandra

God bless you for helping so many people in here.

Without you we would be lost, even though I have not posted before I follow alot of your advice to people here.

I want to ask you, what do you think my case will be? Why the officer ask for up to 4 months to give me a decision

On my i485 interview when my i360 was already approved? After my i360 was approved I apply for travel permit because my mother was very sic in Brazil and I went to see her because she is in the hospital with cancer for the last 3 months and she can die at any time the doctors told me, so do you think that because i left the US and went to Brasil after been here for 8 years will afect my I 485? I m very concerned, they stamp my passport when i come back from brasil with a stamp saying that i am in parole till january 2015.

You travelled on Advance Parole, so it's completely normal that you were paroled into the US upon your return.
