I didn't file cocurrently I filed i485 in June 2013. It was transferred to nbc in October and to my local office in March. Interveiw in April.

Congrats on completion of this BIG n tiring journey !!!!

BTW, how long it took for your VAWA approval?

Any idea how much time its taking these days to get VAWA approval?

I am new to this forum and need your imput. My lawyer says she will file i360 and i485 together, but I read on this forum if vawa is denied, you go into removal? I have told my lawyer this and she says it is not true, I don't know what to do, can someone show me a link online? so I can show my lawyer. Please I need help on this, thank you

Carguy 87 The site provided correct information, but they were clear "If you are in some other valid status such as on a nonimmigrant work visa, student visa, temporary protected status (TPS), DACA, or are not deportable for some other clear reason, USCIS will usually not issue a Notice To Appear (NTA).

They are making reference regarding people with NON IMMIGRANT VISA or temporary status.You will file AOS to become immigrant, then the message you posted it does not to apply to your case at all, it applies for those with student visa,DACA,TPS, but filing AOS your DACA wont' be valid anymore.

So either way there would be a risk in AOS. So I can either take it now and file it all together or do it later. If Vawa get approved but AOS gets denied, because there really is not guarantee that AOS will be approved wth approved VAWA right? Just have to decide what would be best for me right.

The way I understood it was that I would be ok and not be put in removal proceedings cus of daca but from what you said I asked the question here

And from looking on here it seems that VAWA can take many months and then many more months for AOS if I do them either together or separately.

But if I do them together I can get EAD C9 pretty fast and that would make my life a whole lot easier at the moment while I wait for Vawa decison and then AOS and just hope for the best cus if daca will not help me with removal proceedings if get AOS denied I would be taking a risk either way.

I just trying to see what the best route for me to take would be so I'm trying to get as much information as possible.

I also have another question. She kept all our photo albums. I have a few I have been able to get but not many that I found diggin in my stuff and from family.

So far I have.

1 - The very first picture we took together in high school, 2005.

2 - when I first moved in with her,

1 - wedding we attended while she was pregnant with our son.

1 - Easter 2006, while she was pregnant with our son.

3 - at the hospital of when our son was born 2006

2 - family portrait pictures we took, me, her, our son.

3 - our wedding, 2007

1 - at my cousins quinceanera party, 2010, me, her and both of our kids after daughter was born and turned 1.

I'm trying to get more, but how many pictures are they looking for?

Thx! It took 17 months very long and tiring wait but God kept me through it. I think it depends on the workload of the officer who has your case and whether u get an rfe. I did get an rfe so that pushed it to the 17. I didn't rush to send in rfe I took my time cause better you take your time and get an approval than to rush and get a denial. Good luck with everything.

As far as I am concern you do not even need to look for any evidence that says that to bring to your lawyer. You the one paying her she has to do wat you want her to do. And yes if u file both together and get denial you will be placed in removal. Once an i485 is filed and denied you will be placed in removal.

17 Months for VAWA approval only or including AOS?

Without RFE, whats the usual time for VAWA decision?
