MASHAKA911 with a suicide attempt you may have your case denied, the Law is clear, anyone who poses a threat to other or themselves should be considerate inadmissible in the US.

Schizophrenia is a mental illness, and it's not related with abuse at all. Schizophrenia might be caused by genes, or different brain structure and brain chemistry, and if you really had the schizophrenia diagnose they may find you inadmissible in the US.The Law states "Aliens are inadmissible under the physical or mental disorder inadmissibility ground if they have or had a condition that has an associated behavior that poses a threat to the property, safety, or welfare of themselves or others".

If you submitted an affidavit with 100 pages, I bet they did not read at all. It's advised not to submit over 15 pages.Receiving an RFE is NEVER a good sign, it means something was missing in you case, but you will have the right to proof/explain about what they are asking in your case.

Considering what you are saying here, it seems your husband was a cheater. I hope you did not focus in your affidavit about cheating, because USCIS can't care less about these things. When you get the RFE let us know what they are asking in your Vawa case ok.

I will let you know about RfE as soon as I get it.

Hi

And thanks for the feedback

No I did not send a copy of disposition because I was thinking FBI state no prior arrests found so I am not sure if they gonna see my arrest. I was arrested for massage therapy with no license I was looking for a job and first day I was there I did not know what was that they raid the place and arrest me with everyone. :(

I also had a suicide attempt coz if my husband but I did not include it I was in a hospital for it do you think I should send it in?

And my psychiatrist evaluation was sent it and a copy of all my prescription.

You are welcome,

Even if your FBI clearance state no prior arrest, that's because in NY when charges are dismissed, cases are subsequently sealed and might not show up in police databases. But you mentioned that your I-485 was denied because of that arrest, so USCIS already know about the arrest and they will need a certified copy of the arrest report which will be very hard to get if your case is sealed so you will have to explain that to them, AND you will ABSOLUTELY need a certified copy of the court disposition. I'm pretty sure that's one of the things the RFE is for.

Your husband claiming that he will get you deported and threatening your status is most definitely part of the abuse, if you have texts proving that, that is good proof.

You have a complicated case and you might have sent a whole lot of documents that are irrelevant to your vawa petition, and some of those documents may or may not be damaging in the approval of your I-360.

As sandranj said, certain things you mentioned earlier could make you inadmissible to the USA, you might want to consider tightly following sandranj's advice and maybe even hiring a competent VAWA lawyer in NYC because I don't think your paralegal did a good job in helping you file your VAWA package.

mashaka911 I don't understand why the paralegal told you not to tell USCIS that your husband refused to have sex for 2 years, because withholding sex does qualify as mental abuse, and I mentioned situations like yours in many cases, all cases were approved.
