Remind you that cheating is not considered extreme abuse by USCIS. I saw many people that described all cheating and submitted picture,s and USCIS mentioned in the RFE that calling names, addiction,cheating is not considered abuse.

Sandra I didn't send medical with my aos application. I assume recent RFE will be for medical, do you think that they have completed the background screen by now or will it take more after RFE... My file has been at NBC since beginning of November 2013

citragirl it might be regarding medical exam. I have a bunch of cases in the NBC since July/Aug 2013. You have to wait a bit more to have interview.

yes I sent police clearance from FYI for all 50 states.

I sent so much about bonafide marriage like pictures from the trips together pictures of his family with me and our son.

mashaka911 if your case is based in mental abuse then you need to have an AMAZING affidavit(8/10 pages minimum), and a psychological evaluation, and you need to have a diagnose of depression or pos traumatic disorder, it must be an amazing evaluation as well.Pictures do not proof bonafide marriage, but commingling finances yes.

Hi everyone I woke up this morning and got a text 6 am uscis approved my 1360 I can't stop crying I apply December it took three and a half months with no rfe one rfe for ead which I'm still waiting can someone tell whats going to happen next.

Pictures are ok for bonafides but like the very knowledgeable sandranj said the commingling of finances is the most important. You should send leases with both of your names on it, joint tax filing, joint bank accounts, proof of insurance with both names....etc

For the abuse, you said you sent pictures of bruises so you are most definitely claiming physical abuse or both physical and mental abuse, you should send documents such as Police reports, police affidavits, restraining order, psychological evaluation, affidavits from people that witnessed/ knew about the abuse. Text messages are good if they prove your case, if it just proves that he was cheating on you, it wont help, if they prove that he was trying to control you it should help.

How long was your personal affidavit?

Did you have an attorney help you put your package together?

By the way give us more precise details about your case if you want help, list everything that you sent and maybe even a little description of the situation with your abuser.

Also let us know what type of RFE it is when you find out.

for bonafide marriage I sent all the papers you listed(leases with both of your names on it, joint tax filing, joint bank accounts, proof of insurance with both names all electric bills all gas bills on both names )

for abuse i sent the cheating pictures and physical abuse pictures

I will tell the story a little so you can understand

i got married march 26 2009 in New York everything was good we have a child together 3yo son now

i applied for i130 it was approved and i485 was denied co i was arrested 2 weeks before my interview and on interview i did not lie and told the truth

they gave me 60 days to send case disposition but i had it in 70 days so my case was dismissed and i have disposition of arrest and i485 denied

then i filed i485 again and he never showed up on interview he went on vacation at that time'

he very changed start to leave the house without telling me and go travel when i had to go to work and i lost my job like that because no one could stay wit the baby

he started to call all my friends bad names and telling me i should not meet them and i have those txt saved

then he would just leave me with a baby and disappear and i found a flash card that every time he was leaving he was with another women so i send it to uscis

then he took my son to Grenada for 2 weeks i did not mind but i did not here anything from him i was frustrated

ten on a facebook i found a girl he went to Grenada with and she posted my child on her page and commenting its her son it was the worst for me

one time i came back from job trip got home he was not there my son was with him and all my papers was all over the floor

i called police but they never came

i started to call his family he run inside the house with a knife trying to cut my throat my friend wrote an affidavit for it and se called police but police did not arrest him i don't know why of course he hided the knife before they came and in a report tey did not allow me to write tat he was trying to cut me coz they said if i do i will go to jail with him that's how it works

i hade an evaluation from my dr he prescribed me medication for depression and schizophrenia co i was shaking crying every day

he also gave me hepatitis B and i got a letter from dr that i did not have it before i met him now i have it

my affidavit is about 100 -120 pages long

i don't have Police reports, police affidavits, restraining order because his sister works in police and somehow all my police report disappeared

i also send that he is very irresponsible he was arrested with suspending drive license and he did not make a payment on a car so is mom gave him the check coz it was already on collections i have and sent all proof of that

i have paralegal helping me with a case

I'm sorry to hear what you went through.

Wow that's a really long personal affidavit, I'm not too sure if the officer will even read a 100+ page document.

If you sent all the bonafide evidence you mentioned, I doubt the RFE will be for that. I think It's either for abuse or for good moral character or for both.

I don't think the cheating pictures will help your case, as sandranj told you earlier, cheating does not mean abuse. The fact that he did not pay his car note and that he got arrested for his license being suspended does not prove abuse. The physical abuse pictures will help as well as the affidavit from your friend but if those are the only forms of evidence you sent, it might not be enough. Gather any text messages proving that he threatened to hurt you, threatened your immigration status, tried to manipulate and control you...etc You mentioned you had bruises, did you get checked out at the hospital for your wounds, if you did, get the hospital report. You should most definitely see a psychologist for 5 or 6 sessions and get a psychological evaluation.

For proof of good moral character, you mentioned that you got arrested, did you send certify copies of the arrest report and of the final court disposition(dismissal) for that arrest?

If you did not, that might be why you are getting an RFE, you will need to get certified copies of these documents asap. By the way what did you get arrested for if you don't mind sharing?

100 pages is too many. I think Sandra has previously advised 20 - 30 tops, and even then that's pushing it. 100 pages is a novel.

No I did not send a copy of disposition because I was thinking FBI state no prior arrests found so I am not sure if they gonna see my arrest. I was arrested for massage therapy with no license I was looking for a job and first day I was there I did not know what was that they raid the place and arrest me with everyone.

I also had a suicide attempt coz if my husband but I did not include it I was in a hospital for it do you think I should send it in?

And my psychiatrist evaluation was sent it and a copy of all my prescription.
