i need your help again

i will remind you of me

i had an old 485 pending then i got approved for vawa and 2 kids as secondry beneficiaries

i took your advise and filled for 824 to get them to usa and this was before my 485 decission as i am still waitting for my interview appointment

today to my surprise i got an e mail with rfe for my 824

what could it be ?

i thought my 824 will be in hold till my 485 is decided and then 824 will be opened

what rfe ? could it be they will tell me to send the decission of 485 after my interview ???

plz help me

Jawaree Prima facie determination will be made after a self-petition has been filed with the Service for the the purpose of I-360 filers to become "qualified aliens", even without approval of the petition.Once they get the prima facie they become eligible for public assistance such as medicaid ,food stamp, Fafsa, some States do not give food stamp for qualified aliens under Vawa Law,but all of them may qualify for medicaid and Fafsa.To receive prima facie the alien has to prove a qualifying relationship with the US Citizen spouse or GC holder, proof of status of the abuser; show the abuse occurred in the United States,; good faith marriage, proof of battery or extreme cruelty and good moral. Prima facie is just for the purpose of receiving public benefits,that is it.It does not guarantee any approval.

USCIS will expedite your i765 under the circumstances:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

May 5, 2014 - Filed First VAWA

September 3, 2014 - Filed I485 and I765

September 7, 2014 - Found out USCIS administratively closed my i360 because US postal service sent my RFE letter back to Vermont

October 10, 2014 - Biometrics Appointment for i485

Sent USCIS to reopen case, scheduled infopass, wrote to ombudsman

November 4, 2014 - Filed Second VAWA

December 23, 2014 - i765 Approved

January 2, 2015 - Received i765 Card

January 5, 2015 - Applied for SSN

January 12, 2015 - Approval of second Vawa

Approval of second vawa took 2 months and 12 days! No RFE. God is great!

February 9, 2015 - I-485 File is transferred to NBC

May 5,2015 - Received Interview letter for I 485

May 14, 2015 - Interview date

June 22, 2015 - Received Welcome letter and Approval letter. Will receive Green Card within 2-3 weeks

Yes sandra! It was not even 15 days if i dont count the time it took for them to receive it and for them to send approval notice. It was the miracle i needed! God is good all the time. For everyone, it is possible to expedite i765 as long as it falls in the criteria provided by uscis. There is also a burden to prove that need to expedite.

Dear Sandra

I got the rfe note

They say i cannot file for adjustment of status abroad through council and in America in same time so they give me three options

1 withdraw 824

2 withdraw 485

3 hold 824 till 485 is adjudicated then they will process it

So was it a mistake to file 824 while 485 is pending?

Will this delay my 485 are they holding it now ?

What to do?

my work authorization will be expired less than 3 months. My I485 is pending as visa is not available yet for me (I am spouse of PR)

My attorney prepared all my application and came with me to interview.

If I ask him to submit renewal for work authorization, he will charge me, but i cant afford it

Can I do it by myself while he is still my attorney in this case? if yes , would you please guide me to submit renewal request

Complete a new I-765, mark the box at the top stating "Renewal of my permission to accept employment", and enclose copies of your current EAD and I-485 receipt NOA.

Is your current EAD category C-9 or C-31?
