Never been to this thread B4 but thought I would ask here

My wife friend (abroad), was physically & verbally abused

by her ex she was a witness on a case he had and the DA had

gave her a letter, she has a single offence in her background

but figures she can apply for U visa on her own, she has the

letter and a cut in her face, was too scared to have him

arrested, she has a paper where witness protection was offered

but she left to her country, now he has got out of prison & shown

up there and she is in hiding, Since she has no police statements

will it be a problem without the hospital record for her to file?

She says her case is straight-forward & don't need an atty.

I did read up a few things for her about U visa, It does seem str8

forward , but I think with just one witness statement & DA letter

she could get rfe for more proofs which she does not have

JAWARE she needs to have a Certification given by the police or prosecutor stating she helped Law enforcement, without this CERTIFICATION her case will be denied, because it's mandatory to submit the certification along with the application for U visa. Hospital record is not enough.Filing a U visa without an attorney is a bad idea. It's a complicated process, not like Vawa at all.If she overstayed in the US she will need a waiver proving hardship, in the hardship she has to prove why she needs to be in the US(to get some psychological treatment that she doesn't have in her home country?hiding from the the abuser? has an american child? etc).

I think am wrong am not 5 years yet. But am three years now. Cos I have been a resident since november 2011. I called uscis and ask them if am eligible to apply for citizenship they said no, so am confused. I and my husband are divorce. And am not the military so I have to wait for 2 more years. Am confused. Some people already got their citizenship and I don't know why mine is different. Or I should still go ahead and apply? Thanks sandraj. Any reply will be appreciated.

Green card holders (through Vawa) can apply in 3 years.

Only if they were married to a US citizen and not an LPR. Perhaps that was the issue here?

She does have paper from atty gen and DA also witness protection offer

I would say she needs more help psychologically, she is on medication

she says does not help...I called and reason with her that an Atty is

needed , she was grabbed and deported, not only was she beaten but was

held and abused upon ending the relationship, she hides at home in B.....

OK I recommended she speak to Meegan Klundt & she did, and will send all

her history in ...Thank U Sandra.....Mrs Klundt specializes in U visas

that waives all inadmissibilities with proper documentation

Hi everyone!

I am such in a great despair today. Please advise me on what to do...

I have a vawa petition, then I filed AOS and EAD, then they closed my VAWA petition leaving me no choice but to refile another VAWA.

I have been to infopass many times and they cannot give me an answer about my question.

Do I refile a new AOS and EAD based on my new (2nd) VAWA?

I am thinking of refilling a new AOS and EAD package based on my new (2nd) VAWA. Then when I receive receipt notices for that, I will write a withdrawal letter to USCIS and withdraw my first AOS and EAD that was based on a closed VAWA petition.

Please advice me on this one. I am going crazy. I do not know what to do.

Sandra has been so excellent and been so patient with me. Taking time from her busy schedule and giving me advices.

Please everyone, let me know what you guys think!

You can do what you want , but when i was answering your 10 emails and reviewing your form I could be helping others .Do you have idea how many emails I got per day? over 100! and I cannot help everyone.

From now one I AM NOT ANSWERING ANYBODY'S EMAILS ANYMORE.
