Omg I am completely scared an overwhelm my i485 was july 24 the immigration officer gave me 30days to send them di receipt my case isn't fully ready yet and time is running out I am so scared they told me I have send them the receipt by aug 24 I feel like I dont have much time and I have little help I can't stop crying

What do you mean when you say your I-485 was July 24? Who said you have until Aug 24th?

A receipt is a " I-797, Notice of Action" , it's a document that USCIS sends you to let you know that they have received your Application, Petition or Documents. It's your proof that USCIS received what you sent them and that it's pending until a decision is taken.

Try to put yourself together, only you can help yourself do that , focus and put your energy in getting your application ready. Do you have an idea where to start? I don't mean to be nosy but ask this to yourself... What basis do you have for the petition? Physical? Psychological? Whichever it is, gather your proofs. the sooner you start the less stressful you will feel, right now you might feel overwhelmed just kick one thing at the time, but kick

tdiva here is the first steps to follow

1- Get police clearance from all places that you lived in the US since you got here.In your own affidavit write down at the end that you are a person with good moral character and you were never arrested/charged/indicted in any crime in the US or worldwide(if you were not,of course).

2-Write down a very detailed affidavit about courtship,marriage and abuse(since the time you met him,met his friends,his family,got engaged,got married,abuse,separation)

3-Get affidavits from family stating bonafide marriage and or abuse, from family and friends in the US and abroad,if the person giving you the affidavit is living in the US the affidavit must be notarized.The person has to mention full name, date and place of birth,current address and phone number.mention when and how he/she met you,when he/she met your husband.Describe what he/she heard or saw about the abuse,if it's regarding bonafide marriage the affidavit should be from people that met you before your marriage.

4- mail along with form I-360 documents showing bonafide marriage and abuse

5-Submit copy of birth certificate and translation, marriage certificate, proof of status of your husband,divorce decree if you have,divorce decree if you were previously divorced or him,kids birth's certificate(if you have kids,even from a previous relationship).

6-Submit copy of tax return filed jointly, bank statement, health and car insurance, lease agreement etc..everything showing commingling finances and commune residence(proof you lives together)

7- A psychological evaluation if you were mentally abuse.A police report and or restraining order if you were physically abused.Hospital records if you have.Pictures of injuries if you have any

8-A cover letter to USCIS. Make sure to keep with you a copy of everything you are submitting.It does not mater you submitted everything before for your AOS, YOU HAVE TO SUBMIT AGAIN!

9-If you don't have proof of your husband status, try to get through vital record copy of his birth certificate(if he is american),if you can't get a copy then ask USCIS to search in the AOS file about his status ,mentioning the proof of his status was submitted along with form I-485

Reminding you CHEATING is not abuse, problems with in laws is not considered abuse, alcohol/drugs use is not considered abuse.Then don't waste your time mentioning these things.I read so many affidavits telling about the husband/wife infidelity pages and pages,problems/fight/humiliations inflicted by the in laws. Uscis will not take in consideration anything about that. If your husband was arrested in the past for other crimes try to submit his police record(to show some pattern of violent behavior).

Breath ...and submit to the USCIS, with delivery receipt.You don;t have to file new I-485.If your I-765 expired or it's about the expire within 90 days then submit I-765 to renew using category ( C ) (9). USCIS will take AT LEAST 7/10 days to mailed you the I-797.

ok good, but regardless you are not appealing your case, you are re-filing. If USCIS sends you a notice to appear to court for removal and you present the judge with a NEW I-360 receipt showing that you have a vawa pending, the judge will temporarily hold the deportation order until your vawa is adjudicated. This means that you have from now until the court date to file for vawa and receive a new I-360 receipt from VSC which you can subsequently show the judge at the hearing, if you ever get a Notice to appear. A memorandum in Nov 2011 tells USCIS officers to focus more on referring people to immigration court if they are a threat to “national security, public safety, and the integrity of the immigration system.” Other deportable aliens are less of a priority. So this means that you do have a little time, not much but enough to get a lawyer, put a brand new COMPLETE package together and file a new I-360 as soon as possible.

Don't lose hope and get working, find a lawyer.

Thanks a lot for the information. I am writing a formal letter today and notarizing it to officially change my address. I am going to talk to a couple of more lawyers since there is one I have singled out and use this time to gather more evidence.

I feel for you my dear, you work very hard, my brother does that kind of job, fortunately he's a supervisor but I know all of the crew basically works very hard and sometimes your journey starts as early as 2 a.m. This means every penny is very well worked for. Don't waste too much time traveling, or out of work that might lead to loose your job. I was going to suggest if you have time read the first treads of VAWA. I remember a few structures for the personal affidavit there... Then I saw Sandra's reply...she's giving you info, great!!! let's say for example that you explain about a confrontation, explain how it started, what did she do, how you felt during and after what she did in that particular confrontation, and then the same with the next time she got violent... The most important is to explain the details not just, for example: she pushed me, yelled at me, threw a glass at me and walked out the door, explain what, why, how, when

Also Sandra has told you pictures are not everything, if you received any type of mail and or bills to.the same address bring it to your file keep copies of everything that you send, even magazine subscriptions help, usps sends a confirmation letter when you change address did you received one when you moved with your wife? Car insurance under both of your names, life insurance. Bank accounts, if you don't have something explain why you don't, for example if she wanted to have under her name to control the accounts what would she say about adding your name to the accounts, stuff like that... An attorney charged me 1200 for filing my VAWA and at the end it was Sandra who pushed the case through... And many of us did aos in our own of course guided by her. Very important to pay close attention to her advise

Thanks. On common address I do have millions of letters Bank statements and the lease and people willing to swear affidavits.Bonafide marriage I have affidavits, joint tax returns, joint ownership of land, then the mental cruelty I just have to redo my affidavit and see a psychologists.I police clearance from April this year from state of Nebraska and Washington.I did live in the state of Mississippi in 2008 and 2009 and I don't know if it matters.

luoby you need the police clearance from Mississippi as well. As I said many times cheating is not abuse then do not focus on describing her cheating,because you will be wasting your time,focus describing situation you were humiliated,degraded,controlled,threatened etc..explain each situation in details such as when happened,where? in the kitchen,bedroom,street, what time, night,day? month and year at least, how you felt after the abuse...if she apologized after the the abuse,if she made promises to change,how,when,why you decided to forgive her?.Story like " we had a fight she threatened to call the immigration" is not the way to described a situation of abuse ,it must be,for example " On August 12,2013 we were having dinner at home, she started demanding me to give her more money ,i explained to her i did not have at that time,she got mad and started cursing me calling a loser, an idiot ,saying she will send me back to my Country etc..I was appalled t say the least etc'''did you get it? it must be a complete explanation mentioning month,year,time,place,abuse,and your feelings about it.

If you didn't pay the I-485 fee then you will need to apply for a new fee waiver for your new I-765, or pay the I-765 fee.

To add to what Citragirl said your statement is what will make an break your case write from the heart be honest an be sure to explain how you felt the who what when an where.

I actually started a journal when I met my husband just never knew one day I would of had to use it God was preparing me an I didn't even realise.

I met Sandra an found this forum one year after I started my journey and spent $11675.00 yes not a typo that's how much I spent and that was just his attorney fees NOT inclusive of the immigration fees. Sandra enlightened me an guided me plus I kept on this forum an read alot too my attorney was just a paper pusher he did ABSOLUTELY nothing to assist me but fill out forms an ask for money. Have Sandra review your statement she's an experienced attorney an will assist you!!!

Hypnos thanks alot...for my WP renewal,l have decided to do the fee waiver since am not in a position to come up with the money now but hope you dont mind me asking questions since am doing it by myself.when l applied for my Aos,my lawyer used a fee waiver but the only thing he asked was my taxes, but as far as putting together the packet itself how do l do that..do l have to use my taxes again or what else do l need? Also can they take hand printed applications or do l have to type?

You can complete the I-765 by hand if you wish; it doesn't have to be typed, it just has to be clear.

You can read fee waiver information here: http://www.uscis.gov/feewaiver and can complete an I-912 waiver application from that linked page.

You should send the I-765 and I-912 in the same packet.
