godisgreat23 did you apply for work permit? This message can be regarding your green card or EAD, but of course not about deferred action, your lawyer is nuts.Considering you had AOS interview a few days ago I believe you will get your GC in a few days (5/7days).

Sandranj-I didn't apply for ead this time,I got ead last year when I applied by self after consulting you. This says for my aos case number. They don`t ask for any evidence or anything after card production is ordered,is that right?

fancy are you referring to l 90? This form is used to replace a green card lost, damaged etc as far I know you didn't receive your green card yet. ALL vawa filers HAVE AOS interview.Uscis web site is not reliable.

Sandranj

Thank you so much for your prompt reply.Sorry for the mistake.you are right .It is Form I-90.So if Uscis web site is not reliable, how I can get the exact status of my case?It is now 6 months from the day my case was transferred to NBC.

godisgreat CONGRATULATIONS! your green card will arrive next week for sure.I told you last week they would approve soon. After getting the GC it's over, they won't ask anything, anymore.

Your lawyer needs to study about immigration law, tell him that USCIS NEVER EVER will issue deferred action after AOS interview, just before, and they never ever issue EAD if you did not apply for, then what he is talking about is just bs.

Hello there, Subjected to domestic violence for 2 years now, I have filed for a fee waiver on my ROC and "cruelty" ( I have no job as my "loving" US husband has isolated me in a place where without a car, I cannot get a job and he keeps the car for himself.) Please no lecture about how hard it is to prove cruelty or DV, it is NOT hard if you have the right documents. Now if you don't have these documents, that's another story but it is far from being my case ( about 5 inches of police reports, hospital reports etc).

-After 3 weeks waiting for the receipt #/NOA, I called USCIS, I have been told by the officer that I should wait for 30 days after I sent my application to make the slightest inquiry.

-Today was the 32nd day, so I called back since I haven't received any receipt # from USCIS yet. I have been transferred to a higher level where an officer told me that asking for a fee waiver was adding 30 more days to the process, hence I should not make any inquiry yet. In other words, they will only be considered late in the process when we will hit a whopping SIXTY days after my ROC was filed. It seems a bit crazy and I am wondering if he did not tell me that just to get off of the hook without having to start a research.

offtopic45vn.gif From a strict commonsense standpoint, I don't get how they think they protect DV victims by doubling processing times! It goes down to giving the abuser 60 more days to molest/ stalk/harass/ abuse his victim, and also countless occasions to just kill her.( some people need to take critical thinking classes urgently or need to get stuck for a few months with an abuser, they would develop some new skills/opinions/ideas).But I digress. Off-Topic2.gif

According to this officer, it's been already 32 days but it is not enough, so if I haven't received any receipt #/NOA in 28 more days, THEN only should I call back.

First question: Is this true or is it baloney? ( needless to say that, from previous experience, I don't trust the answers given at the USCIS customer hotline as I have had to go to the field office to get them to figure out where my AOS file was otherwise I imagine that I would be still waiting by now.)

Second question, if I receive no receipt number before my card expires, the officer told me that I would then have no legal status (another outstandingly brilliant measure to protect DV victims I guessranting33va.gif ) how many days do I have before I have to leave the country? (I don't know how I could possibly do that as I have no money to buy a plane ticket).

Anybody has some recent experience with this process?

Kindly

Ag

1. Why are you still living with the abuser? It is not up to USCIS to protect DV victims. Call a women's shelter, contact the police. There are lots of resources available for abused persons. What does USCIS have to do with removing you from the abusive situation?

2. When you receive your receipt for filing (NOA-1) it will act as a one year extension of your green card.

If you are being abused leave the home immediately. Do not remain in an abusive relationship. A shelter will provide you not only with a place to stay but they will also assist you with locating work, transportation, legal assistance and other things. If there is no shelter available contact the police and ask them what you can do. Why don't you have a restraining order against this person?

You have two separate issues here. One is abuse. The other is the removal of conditions. One is not related to the other. All you need to do to file ROC is provide proof that you entered the marriage in good faith, you do not have to still be married to the person to renew your green card.

Thank You Sandranj.Love!!!!! I checked my status now it is back to decision where it says we have registered this customer`s permanent resident status and mailed the letter for the same. Please 60 days for your card to arrive or after completing any ADIT with welcome letter, whichever is later.(earlier it said card production ordered)

I don't know what is ADIT?????

Also in my latest fingerprinting appointment my letter had only code for FP only and not photo. But I did sent my two paper photos sized as per rules ,but I am wondering because I read somewhere photos for GC are taken at ASC where fingerprints are done. I don't know if they will send the request for photo now,but they should have done it together with fp.Does people here had to get photo at ASC or paper based photos sent with 485 was fine. Please provide some answers Sandranj.

AT2000 USCIS take 20/30days to mail the extension letter, there is no difference in the timeline if the alien pays Uscis fee or submit form I-912(fee waiver)

We have over 2.000 shelters for victims of DV across the Country.Second the National Network to End Violence on September 25, 2007 in JUST 24 hours 25,321 domestic violence victims found refuge in emergency shelters or transitional housing provided by local domestic violence programs, and 27,882 adults and children received non-residential services, including individual counseling, legal advocacy, and children’s support groups. If you fear for your life then seek refugee in a safe place.
