I am so sorry to hear that! This is a sensitive issue, personally I have no idea what are the consequences. I have read that you are forgiven if you have worked without EAD before filing VAWA, but after somebody says it is a strict NO NO! I kind of feel for you, I am out for work for three months now, filed for new EAD in the end of February, but they are still taking their time, even though it was partially my mistake (did not send pictures) - still it is ridiculous I believe. I live off credit cards and my family help right now. Again what I said about EAD - it is rumors, based on nothing, so I am not much of help. BUT, what I suggest - is to file for couple of credit cards! That will help in future with enourmous expenses, I do not think USCIS cares if you have a debt to a bank, just if you had issues with EAD or sometimes even welfare situation. Again, I am sorry! Wish you luck!

Thank you for the response! Unfortunately, I did this option after leaving the ex. They are now unfortunately maxed out, and my credit is completely shot - and so unfortunately there is nothing for me to do with regards to this. Thank you for the advice however!

Somebody sent me a pm, I'll answer here in case somebody else needs to know this. I did state in my application that I was arrested, the case was dismissed and I requested a certified copy from the court house. I sent a copy with the package and I was asked again during the interview and as Sandra always suggests when we had something related to law enforcement I took another certified copy which the IO kept. Remember we have to state the truth in the forms. To the member who is having financial hardship, remember we cannot advice you to break the law but we will be forgiven for working before filing, once we file we shall not work without work permit, however you will be given a prima facie document which helps you receive benefits, I did sell cakes and clothes and belongings I didn't need or that I could get rid off at a local flea market while I was waiting on approval of my I-360, in case you want to consider that option

So, please correct me if I'm wrong - but working BEFORE filing for VAWA, will be forgiven - but if you work AFTER filing VAWA, it will not? Can common confirm this? So, if I was to use my SSN, knowing my EAD has expired, and I quit before I file, it would be forgiven? I'm not looking for advice on avoiding or breaking the law - Im just looking for advice on what will happen if I do, with regards to my VAWA application.

If I can do the above, then this may be the lifesaver I have been looking for. The ability to work, until I file, will allow me to actually pay for everything needed to file! This gives me some hope. Can anyone confirm this info?

And thank you for the advice too - I have pretty much sold everything I own now, I'm down to just my phone and laptop that I use to access the internet, and the place I can work on my documents and save them!

Hi guys:

I'm having my I-485 interview this Tuesday 8/5. I was only asked to bring the appointment letter with me along with my original birth certificate and documents from court if I have been arrested or charged in the past. I haven't.

I filed for AOS with my VAWA case approval and I was hoping I could get some advice from your regarding what documents to bring to the interview additionally to the ones asked by USCIS and because I'm a man who got his VAWA approved, any other advice or tips regarding what I should expect from the officer at the interview based on experience.

baldor if you were arrested or have any restraining order against you then get a Certified Court Disposition,plus take all original documents such as divorce decree if you have, marriage and birth certificate,valid passport etc.

I have not been arrested ever so I'm guessing I don't need to worry about that part. How about if my passport is currently expired? Would that be a problem? I do have a valid state ID and my SSN card. Thank you.

baldor21 you should have a valid passport,you can get a nasty officer and then have problems because of that.

By the way it's not wise to be in any Country without a valid passport.Imagine if an emergency happens in your home Country with your parents/siblings.

melanieuk I had AOS approved in 3/4 months after Vermont shipped to the NBC, then local office, but i have a bunch of cases still waiting 7/9 months,then I would say the AOS can be adjudicated in 3/9 months.

What about just the adjudication of the vawa petition?

Already posted this question here, but got mixed answers. Is it safe to travel with AP while waiting for VAWA and AOS adjudication?

A country of Immigrants, that hates new Immigrants... Maybe if education was a right and NOT a luxury, it would be different.

Melanieuk Vawa cases are taking 2/5months to be adjudicated . I do not recommend to travel with AP if you are out of status in the US,there is no guarantee of reentry even with AP.

Sandra, but why would they issue you a document that authorizes your entry? It's a bit confusing.

Cos they don't bloody care about your situation, at point of entry, the IO has the power to allow entry or send you back if they feel your paperpack isn't up to par. I would be patient and wait for the GC.. you have approved vawa, right?

Mielanie UK USCIS often issues AP ,but it doesn't mean the AP will guarantee the alien's reentry. Please read here what the USCIS ombudsman said about it

"...Advance Parole does not guarantee entry into the United States as foreign nationals are subject to inspection at ports of entry by Customs and Border Protection (CBP). For more information, visit the Advanced Parole section on CBP.gov.

The BIA(Board of Immigration) held that a departure under advance parole does not trigger this inadmissibility ground(Matter of Manohar Rao ARRABALLY, Respondent Matter of Sarala YERRABELLY).But despite that the USCIS Ombudsman warns about travelling with AP when out of status.

Seriously I admire Sandra's patience!!! Some of you don't even bother to read the previous threads. Just so you know there's loads of information from members who have gotten thru the same journey... Only difference now is that Vermont is takin way short periods of time t decide. I personally waited a year and 4 months before getting an approval for I-360...any way what is the freaking rush to travel outside of the US??? Read before making yourselves "victims " again. We all have grandparents, some of them dieing in our home country, there's been mother's who haven't seen their children in years in this forum. There's plenty of variety of tough situations here, some of you people are just lazy to read or click into the links Other people share for your knowledge!!! If you are in such rush to visit your countries just go back, you should worry to become an asset to this country which has plenty of opportunities for all of us regardless of our immigration status. Why do you think dreamers are educated? Because they didn't stay still to whine.

Btw I forgo to mention that IO asked if I have gotten married since I divorce, I haven't and not even looking for a partner now, but some had pop that question... Again go back and read what Sandra had advise in regards to that. You all have a nice day.
