THISISLIFE you filed Vawa when you were in the US and now you are in India right? I hope you did not overstay in the US,otherwise you might be barred from reentering the U.S (3 & 10 year bar)

Yes I filed in US and currently in India. I did a little research and for people with approved vawa overstay is not considered. Secondly I don't think I overstayed as I filed my I 130 after marriage while I was still in legal status in US. I left US in March 2013 and my vawa was approved in June 2013.

Thisislife your search is just partially correct, because overstay is not considered for Vawa filers ADJUSTING STATUS in the U.S! this rule does not apply for people having interview abroad.

It seems you don't have a bar considering that you maintained your status.

My file is in NBC since September and still don't have any move sad.png

My lawyers' incompetent secretary went ahead and mailed off my file seperate from my sons' own his file has been sitting at a 'uscis office' since Dec 2013 and mines since Jan 2014. I praying they are both at NBC and the officer joins our files together and sends it to the local office to set up an interview date. Im anxious for a date but more anxious about them bringing our files together I dont want them going back and forth.

Does anyone in this forum face a similar situation or if you did before how was it handled?

mashaka911 the answer is NO! they adjudicate all cases equally regarding timeline,despite some people are approved faster than others,but because of each officer work load not because someone has a child or not, regarding bonafide marriage is discretionary then having a child it might have a little impact, but not to the point to approve the case just because of that.

Is filling I-190 may fix my problem of not receiving my green card?Does every VAWA approved applicant must have interview for green card or you can get your green card without any interview?are the info regarding my case on USCIS.gov is always accurate and up to date or I can verify the status of my case through more formal credible source?

fancy are you referring to l 90? This form is used to replace a green card lost,damaged etc as far I know you didn't receive your green card yet. ALL vawa filers HAVE AOS interview.Uscis web site is not reliable.

Hey everyone,

Just a little bit of my story maybe someone has had a similar exprience and this may just encourage another one to just hang in there and hang on. I really appreciate informative forums as this one. It has personally, helped me a lot even though i have an awesome lawyer who really fought for me to come this far. I got married in the UK but not in court, in church (basically white wedding). We did not file for a fiance Visa, being deceived that once we go to court and he begins to file for me things would be easier. Little did I know.

Apart from surviving the abuse another very difficult thing I had was number one finding a lawyer I could afford (that without work) number two proving that my marriage is actually legitimate. I sent in the first pack in early of 2012 and wait, a week later I received my receipt. And kept on waiting. I shortly after received my PF and waited for 6 months. 6 months eventually turnered into almost 14 months before I received an answer. When I got a reply, i was told in a ten page letter that the evidence i have submitted was not enough. And i need to get more evidence, I was given a deadline of 4 weeks and resubmit my petition. I went to dig out all information and letters and email and what not i have had of the past ten years of being with my ex husband. Went to get a psychological evaluation and all and prayerfully re-submitted it all.

About 2 months later my Vawa petition was approved and I began to wait for my adjustment of status. In 2012 I had put in the applications all together to speeden up the process, according to my lawyer. I received a reply early January to come for my Green Card interview. Went to see my PCP and have him give me all the vaccinactions I needed even the ones I don't to make sure that i have all my tracks covered. While i was trying to get that all in check I had already received my apointment for the fingerprints. I am very excited about the developments. This is just to share and encourage some of us in here. They key it to never give up and find a way to fight for your right.

If the fingerprint apointment had been set already, how long would it take for the GC to be processed in general? Also if my passport has expired (Austrian EMbassy is not willing to reissue passports without proof of GC) would thet give me the card instead? Normally they do stamp the passort right?

blackpeearl299 they do not stamp the passport anymore. It's advised to have the passport renewed, but i heard at lest 3 cases that they did not say anything because the passports were expired, and they approved the Green card without any problem.

One girl in Florida had interview and fingerprints on the same day, the officer said it would take 30/60 days to receive the green card, she got the green card last Saturday ,15 days after the interview and fingerprints.

It varies from state to state; you would need to contact the Georgia DMV. If I had to guess I would imagine they will want to see your EAD first.

I am trying to set up an infopass about case being too long at NBC. Can somebody who have already set up an infopass appoitnment can help me how to set up the appointment?

I went on uscis.com - set up infopass-

After choosing the option

You need Service on a case that has already been filed

What is the next option I have to choose? Case processing appointment ?

Hello Sandranj,

now my case status says we ordered production of your new card,please allow 30 days for your card to be mailed to you,we will contact if we need something from you.Is this an approval of the case?

I called my lawyer and he said hold your horses,and don`t be that happy as it can be work authorization card that they may be mailing to you or some deferred action card,we need to wait until we receive it.From the very start he has never given me any reassurance,is it over yet or they can still delay it? Please tell me the truth Sandranj.I also checked by dialing their answering machine on helpline number it says the same as online .I know God is with the truth and sufferers of abuse will get justice.
