Hope my ead will be approved soo I just dont understand how come they transferred my case to local office before they approved my ead

mashaka, I filed, I-360, I-485, and I-765 all together in June. I had my biometrics appointment July 9, and on July 21, I woke up to text and email messages on my phone that EAD has been approved, then that same day, at night, I got another text and email message saying "Card/ Document Production". So just waiting to get it in the mail now, so maybe it will be soon for you too.

melanieuk here is the list with reasons that an alien can ask to expedite the case

• Severe financial loss to company or individual
• Extreme emergent situation
• Humanitarian situation
• Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
• Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
• USCIS error
• Compelling interest of USCIS

mashaka911 the EAD approval may take 30/90 days.They transferred to your case to the local, because that's the way it is, but soon they will transfer your case to NBC, and your AOS will seat there for a few months.

Sandra on your experience how long usually people wait aftet fingerprints the case to be transferred to local office?

luoboy you can refile anytime you want.Forget about the infidelity things, and being assaulted by her lovers, USCIS won't take any of these allegations in consideration.You have to show humiliation,degradation,control,threats,coercion etc.(not regarding cheating).It seems you focused in infidelity and being assaulted by her lovers, as I said before these are not grounds for Vawa approval at all.

If what you suffered was what you wrote here then you were not abused, you just had a bad marriage,you were not marriage to an abuser,but to a loser.If the psychologist does not give you a diagnosis of major depression, and/or post traumatic disorder and/or anxiety then you were not mentally abused.What you believe you endured must be corroborate with a psychological evaluation. A lawyer can help to put your case together, but you need to have grounds for Vawa.

mashaka911 they may take 4/5/9 months. They do not ship the case to the local office, because your had fingerprints done.They adjudicate the cases in the order they are received, but some people may take longer than others.I had cases that stayed 4months at the NBC and i have cases pending there since September 2013.

The first RFE talked about your first lines. In the next affidavit I reminded that actually my wife called to find out what time I was coming home and which road I was using. Then when I am walking home I see this guy look at me with a mean mug. I ignored him and walked past him then the next minute he tries to catch me with a soccer punch. I backed off thinking it was a high random punk. I dialed 911 and told them I didn't know him.I called and told my wife what had happened .Then the next minute she called me from the exact place I had been assaulted from.

I didn't have no psychological report or counselor's letter.I changed states and address when I REPLIED RFE.

Initial RFE was good moral character but I first sent county based finger prints and swore affidavits that I had never committed no crime.

The second RFE was bona fide marriage and abuse. I sent bank statements, land title from Africa, And another affidavit of concentrating on courtship and mental abuse. I did rush the mental abuse one though coz my RFE was to be received on deadline day.

First affidavit was 25 pages then the second was 20 pages.

I did not have a lawyer. Then my question is after how long Am I able to re-apply?. I can get both a counselor letter and psychological evaluation. I can get 2 affidavits of bona fide marriage from my sister in law and mother in law. My sister and mother living in Africa. I can get affidavits of mental abuse from my 2 friends, My wife's former best friend and a former co-worker. I am going to see a lawyer today.

Your I-360 package seemed unorganized and weak. I am not saying that you didn't suffer abuse, I am just saying that you didn't do a good job proving your case with USCIS.

You needed to prove 3 things : 1. Abuse (mental or/and physical), 2. Bona fide Marriage and 3. Good Moral character. According to USCIS you didn't prove 1 of those, 2 of those or maybe even all 3.

You will only have a month or 2 to re-apply, it is undeniable that USCIS will put you in removal proceedings, but if you re-file your Vawa they will put the removal proceedings on hold until your new Vawa petition is adjudicated.

You need serious help from a lawyer ASAP. Yes there is great information on this site, and many on this forum have filed their Vawa petitions with the info gathered from this site, without a lawyer and got approved but at the stage you are in now, you need a lawyer to help you re-file.

I spoke to a lawyer today who said I did suffer mental cruelty but my package was very weak and USCIS ignores packages with no lawyers. I tried to ask if we could file before I am in removal proceedings though he ignored that and said we should go slow because all what matters is winning the case. He told me to get him the denial letter first and mean while see psychiatrist/therapist because he could read the stress on my face. He talks like the removal proceedings is nothing. I want a lawyer who is willing to file before I get in removal proceedings. He said he has a good success rate in VAWA cases. He has done hundreds of them.

Vermont sent the denial letter to my old address in Washington even after I had sent them a change of address form meaning they did not look through the package.

I filed without a lawyer and was Approved and many people on this site file without lawyers and get approved. This lawyer sounds like he just wants money. Did he tell you a price?
