Yeah, I figured! Unfortunately, I'm short on choices on this front at the moment, and need to make sure I have some form of valid ID to use - as my passport expires in September, so I want to make sure I have valid ID, so applying for my drivers license in the UK, and giving a UK address is about my only option unfortunately!

Hi TariesL, I am British too, and know for a fact you can apply for a new passport at the embassy in Washington, try looking it up online, I have been very lucky to be able to use My passport in my state without any issues. Hope this helps :)

Thank you!

Unfortunately, the problem is cost. I don't have the financial resources to renew my passport currently :(

That would be a crime under British law, to fraudulently obtain a British driving licence when you were not entitled to one. I would strongly urge you to reconsider that.

One option may be renewing your passport for a year. Because of the current backlog with British passport applications doing the rounds on the news, they are offering one year extensions to British passports that have expired or are about to expire. I believe this service is free but you have to do it in-person, either at the British Embassy in DC or one of the consulates around the country (I have one near me in Houston, for example).

That might be worth looking into.

Hi everyone I am new to commenting but been reading. Here is my situation, after filling for vawa and EAD ON December 26 2013 I was first sent a NOA on the EAD on January 6 2014 and an initial RFE of GMC on January 9 2014 which I replied WITH an affidavit and a county fingerprint clearance. I didn't receive a prima facie and MY EAD(c31) was denied on February 04 2014.

Then on March 21 2014 I was sent an RFE on Good Faith Marriage, Common Residency and Extreme battery. My deadline for submitting the evidence was June 16 2014,I collected evidence and because my spouse kicked me out of the house after finding out I filed for VAWA(which she found out after the Initial RFE evidence was sent to where I lived instead of the homeless shelter as I had asked them to. The EAD did go to the homeless shelter.) I had no where to live and moved to another state where I had friends from back home in Africa. On June 13 2014 I replied to the RFE with a whole bunch of evidence. I mailed it through USPS one day express which arrived on June 14 2014 and was signed by a one A SHELBY.I filled a change of address form AR 11,APPLIED FOR EAD(c09),AOS, biometrics form and the fee waiver form for all the applications that needed being paid for. On June 26 2014 I received NOAs for both the AOS and EADs. Which says the EAD and AOS applications were received on June 16 2014.The deadline day for the RFE. Though my VAWA status still says On March 21 2014 I was mailed an RFE. Does any one have an idea of what is going on. All responses are greatly appreciated.

I would suggest you do an info pass, it seems they got all the info you sent, but like most say, their website isn't the best when it come to updating status. Call them, make an appointment to ask all the questions you need answering. Do you have a lawyer?

Unfortunately I am unable to afford a lawyer and therefore doing everything by myself through research. In the initial application I did send them joint tax returns, IDs, a 20 page letter describing the relationship I mainly based my abuse on the continuous infidelity, hospital reports and police reports by men she was having affairs with, I sent a whole bunch of letters received at the same address. Not forgetting documents that showed I had lived in the shelter on numerous occasions been thrown out of the house and how she managed to mess up my credit.

and after the RFE the evidence I sent included police clearances in both states I had lived in the last 3 years, Joint ownership of land for our vacation home in Uganda, a 20 page letter describing emotional abuse and letting them know the dude who assaulted me was a set up something I knew through a friend she grew up with and I always knew as her best friend.(That friend is willing to swear an affidavit in front of a USCIS officer.)I sent all the bank statements I could find that I had received at her home. I have her own family members and friends willing to swear affidavits not forgetting my own friends who I made when I joined my spouse in Washington. I am unable to get wedding pictures because she has them in the house and told me I could only get access to the house after I withdrew the VAWA application. She even sent back the RFE that was sent to her house where I had moved out and I had wrote a letter to Vermont while replying the initial RFE that I had been thrown out of the house after they mailed the initial RFE to where I lived instead of the address I had filled in the form. I didn't forget to include a diagnosis of chlamydia that I contracted recently because of her Gross Infidelity. I let them know she had threatened to lie and send me to jail if I hadn't slept with her. I am still collecting more evidence.

luoboy you said" I mainly based my abuse on the continuous infidelity, hospital reports and police reports by men she was having affairs with.." INFIDELITY IS NOT CONSIDERED ABUSE BY USCIS.I hope you proved mental abuse, because if your affidavit was mainly about infidelity they will not approve your case.

You said your friends are willing to write down affidavits, well you have to submit the affidavits , and not just mentioned to USCIS they are willing to help you.As I said before if her family and friends will give you an affidavit about her infidelity, then you will waste your time.

Thanks as always Hypnos. I definitely hear you on the fraudulent obtaining of a DL. Its not something I'm keen on doing, but I guess when facing VAWA, you have to do what you have to do - Some people have to work illegally to support themselves, I guess mine is going to have to be getting a UK license. I live in California, and so getting anywhere without a car is virtually impossible - and with everything I need to pull together to send the VAWA file off, I need to get around a fair bit, and so therefore need to be able to. Renewing my UK passport is the only way I can think of doing this, as I can't get my CA license until a new EAD is issued. Its definitely food for thought! If I can get away without doing it, then I obviously will - Im just trying to cover all my bases at the moment!

And thank you for the Passport info. I heard about the delays, but I didn't know they were extending for a year. This is very interesting and something I will absolutely do. Do you happen to know if this is a free year extension? Will it matter if Im currently here on a technically now expired VWP from a few years ago do you think?

You can read up on the passport extension process here: https://www.gov.uk/get-an-emergency-passport-extension-or-child-travel-document

It says "no additional fees" so I assume it's done at no cost. The biggest drawback, as I said above, is that you have to do it in-person and cannot do it by mail.

You seem to be in California. There are British Consulate-Generals located in both LA and San Francisco, so perhaps you could have this done at either of those locations if you can get to them.

The British government will not care if you are illegally present in the US. I renewed my British passport when I was out of status.

Thank you for those links! I took to google and wasn't able to find what I wanted, so that is a huge help! I'm going to give them a call tomorrow and see if I can go in this week and sort it out. It definitely won't hurt to have the extra year!

All information I give in this thread,or any Visa Journey thread is for information purposes only ,and it should not be used as a legal advice.I do not allow anyone to mention my name in the affidavits, since I am not representing anyone here .

I helped hundreds of visa journey members reviewing their affidavits ,helping them to answer RFEs,but nobody is authorized to mention my name without my written consent .

So l just came from my aos interview ,Oh boy!! I,m still shaking..I,m really nervous bcos the officer did not give me a decisiob right there..she said she,s holding my case for further revie(whatever that means) She was obe of those meanofficers and she tried to ask me about the abuse and my lawyer jumped in and requested to speak to a supervisor and the supervisor told the officer that she,s not supposed to ask about the abused...she was not impressed with the wgole supervisor thing so l figured we started off on a wrong foot..she kept insisting that she has a right to ask about the abuse,it was kinda like an argument going on...then we went thru the yes/no questions then she gave me a letter that says waiting for further review..she kept another copy and wrote my name in red.the one she gave me was in black..someone please shed some light..she said it could take 120 days..
