With an approved I-360 the approval of the I-485 is usually just a formality. Denials have happened, but not often, and are usually from inadmissibility issues. I think remarrying before VAWA approval is something that will cause a denial, also.

So my I-485 will stay active and open once I submit my I-360? Until the I-360 reaches a decision anyway? What happens to the I-485 if the I-360 is denied however? Does it instantly also become denied? - And if so, will I have to resubmit an entire new I-485 with the refiled I-360? - And if that happens, does the new I-485 cover me to allow me to stay here whilst the refiled I-360 is processing? Sorry for all the questions!!

Also completely unrelated: These may be two stupid questions, but I figured I would ask. I already have an I-485 pending. This got me my original EAD which has now expired. Can I use this I-485 to apply for a new EAD before submitting my I-360? Or is this generally a bad idea? (Im just trying to figure out a game plan to be able to start earning through this process, legally, and quickly!).

Secondly - with my EAD and SSN I was able to apply for my California drivers license (but never did) - now that my EAD has expired, it there a was to still apply for a drivers license without the EAD, but whilst my I-485 is still active, so therefore not here illegally? I have access to a car, and driving it would make life so much easier currently, but obviously I don't want to do so without a license and risk being arrested!

If the I-360 is denied then the I-485 will probably be denied not instantly but shortly afterwards.

You probably could send in another I-765 using nothing other than the NOA for your I-485, but honestly I'd be wary of that "poking the bear" and causing them to act on (read: deny) your I-485. As I've said elsewhere, it's surprising that that hasn't happened already.

I would personally wait to file a fresh I-765 until after you've filed your I-360, that way you have a little protection (not much, but some).

You won't be able to obtain a driver's licence in CA without an EAD. I believe they are starting to issue licences to undocumented immigrants early next year, but obviously that won't help you now.

As for poking the bear, that was pretty much my thoughts. I guess I'm just anxious to start working again, this is the longest I haven't worked in over 13 years, and its taking its toll!

Why would you wait to file the I-765 until after the I-360 is filed, and not filing them together?

And I didn't think the drivers license was much help. My UK license expired, so I'm trying to figure out a way to get that replaced whilst being in the US so I can at least drive with that for the time being - but thats proving more difficult than I would have liked!

You can file the I-765 with the I-360; I guess I should have said "with or after".

You can't renew your British licence without being a resident of the UK.

Sandra do you know in how long after Vermont received my I485 cash the check? my I485 was delivered Tuesday and till now they did not cash the money im so worried.

It can take up to 30 days.; sometimes even longer than that during very heavy workloads, but most people will receive them within that timeframe.

Mashaka I mailed out I-360, I-485, and I-765 all together on 6/4/14 and USCIS got it on 6/7/14 and the sent out receipts for all 3 on 6/16/14 and I received them on 6/20/14. And today 6/27/14 I got biometrics appointment in the mail.

Still no prima facie though, not that I need it, don't need any public assistance, should I have got it by now?

so it's like 20 days after they receive it.

I mailed my I485 after my vawa was approved. Tuesday they got it June 24th. But they didn't cash the check till now.

My vawa was received by vermont January 30th

I received my prima Facie February 18th.

No it's for your I-485. EAD doesn't always require biometrics.

Oh I see. And I sent fee waiver. When I got receipts saying they got all my stuff it was on the receipts stating that fee waiver was approved. So it was from the 7 to the 16 when they mailed the receipts to me to make a decision on fee waiver.
