Hey,

I'm hoping for a little clarification on something after getting back to the last couple of pages here. My confusion lies with the topic of the I-485, and applying for EAD. I read a thread from Sandranj saying that if the I-485 is denied, you will be removed, but not if you don't apply.

I already have a pending I-485 (Currently, this might be denied before I send of VAWA but I hope not). I need to work. I have no one else to support me, and so to be able to live during the VAWA process, I need to be able to earn. For this to happen, I need to apply for EAD with my application - because I have a I-485 pending, can I use this to avoid filing another I-485?

How long is it currently taking from filing to receiving EAD? As I need to make sure I can live during this time.

And finally - based on Sandranj's knowledge and information above - is filing for I-485 and EAD advisable? Knowing that if it is denied, you will be removed from the country? And by removed from the country, do you mean - immediately? If that is denied, does that mean I can't file my VAWA again or appeal?

TariesL you have a pending I-485 already, then you should not file another one.You can file I-765 along with form I-360, and submit proof you have a pending I-485.

Uscis usually takes 30/90 days, I saw people getting in 15 days,others in 30/60 days.If your Vawa is denied, you can refile again,forget about appeal,just 1% is approved.

Just remind you folks that the picnic was canceled,because it will rain, but we will have the meet Saturday at 1pm in a different place.I posted before here,but in case someone did not read yet, then here is again.Raining or not we will meet up in the Trump tower .See you there.

It will be in the winter indoor garden in the Trump Tower 725, Fifth Avenue (between 56th and 57th Street) at 1pm. Do not bring food,once the picnic will be around September or October.See you there .

Sandra, this morning I got an email from uscis that my card was maild today to the address in file please give 30 days for the card to be maild...

Few minutes later I another email saying today they mailed me a approval later and alow 60 day for the card to get to my adress?

Which one is it? I'm confused !

I need to travel in two weeks, any idea?

I got an email this week that my I-485 was transferred to my local office which is Fort Smith. Its a really small office. My medical was done in November 2012 and was submitted with my previous AOS prior to filing for VAWA. I am expecting to receive an rfe for the medical since it was done about 14 months prior to filing the new AOS. Since my case is now at the local office do you think it is a good idea to have the medical done and send to the local office instead of waiting for an rfe? My file hasn't gone to NBC according to the website update. I'm hoping it will just stay at my local office until adjudication as NBC seems to add 6-8 months to the wait time before going back to the local office.

VAWA

February 10, 2014 - NOA1 for I-360, I485 and I-765

March 14, 2014 - Biometrics

April 4, 2014 - Approval of I-360!

May 14, 2014 - Approval of EAD

June 23, 2014 - I-485 transferred to NBC

August 7, 2014 - Put in service request

September 23, 2014 - Interview - approved!

October 4, 2014 - Green card received

Total time:7 months 25 days

I think you should schedule an info pass.

A country of Immigrants, that hates new Immigrants... Maybe if education was a right and NOT a luxury, it would be different.

BEN B You will receive the cover letter and GC in 10days maximum . They Always put 30/60 days ,but once you got the email saying about the letter you will get the letter and GC in a few days .

4/5 days before your trip if you didn't receive,the GC go to info pass to have your GC STAMPED in your passport,it takes 30min.If you want to set up InfoPass now ,set up to go there in 9/10days if you get the GC then cancel the inolfopass appointment .

Hannah DO NOT MAIL ANYTHING whitout RFE.If you want to have medical done to take to the Interview then it's up to you .I saw people approved with medical exam expired ,and I saw them requesting a new one ,then you have to decide what's best for you .
