Hi im a newbie here..

Just wanted to ask regarding the annual income tax. My husband just got his w2, and his recent annual income is $19187. Based on the poverty guidelines, if im not mistaken if there are 2 in the household only it should at least be $19,387. His previous income was more than $20000. It so happen that last 2013 he was here in the Phils. for more than a month thats why his income goes down as it was shown above.

Is there any way for us to file the AOS even without joint sponsor? Can he use his bank accounts and 401 as part of liquid assets as a proof that i wont be a public charge to the US Govt? Or do we really need to find a joint sponsor.

Let's say he hadn't come to visit you, would his current income be over the guideline?

Yes, his income would have been more than the guideline thats what he has told me.

3x the difference in dollar amoumt. So if you are short $1000 you'd need $3000 in assets to make up the difference.

So if its over the guidelines he should be fine. It would be good to include assets if you're close anyhow.

You should be fine. If you feel stressed about it, you could file for a joint sponsor, but I wouldn't worry.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.

No, they do not use average income in any way. They may be interested in average income but, for example, if you made a hundred thousand last year and the two years before that but quit or lost your job at the first of the year, your average income means nothing. You don't qualify because your current income is zero.

For the case in question, unless the petitioner/sponsor is self employed, the "current income" that will qualify him is what his pay stub says he's earning now. The past income information is required on the form but it is not how one qualifies as sponsor. On the other hand, if he is self employed, his current in come IS his total income on the 2013 tax return, and if not enough, he'll need to use assets or find a joint sponsor.

Facts are cheap...knowing how to use them is precious...
