Hello everyone,

We are getting ready to respond to our rfe about us having a bonnafied marriage and i wanted to ask you guys if you know if its enough to send joint Tax returns for 2013, one Joint bank account and a one Joint Credit card are they good proof of a bonafied marriage?

I'm confused by your timeline where/when you got the RFE.

But- anything to show you're together is good- tax returns, bank accounts, insurance cards/policies (car, health, life,) certified/notarized letters from friends and family testifying to your relationship, photos together (dated on the back,) travel tickets with your names on them, wedding and engagement ring receipts, call records, emails, letters, copies of Christmas cards, house/apartment leases, etc.... submit it all if they're asking for proof! :)

Suggest you visit the ROC sub-forum, and prep your submittal based on the stuff they have to submit.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Certified copy of Marriage Certificate instead of an ordinary copy might be one place to start. Considering that you just got married and your spouse may or may not have a SSN yet, it is hard to get a lot of the information that is used for the ROC phase. How about items with the same mailing address like IDs or bank statements. You actually have more financial information to send in then we did. All we had was the Marriage Certificate, her listed on my employer's benefits as beneficiary, her listed under my health insurance as spouse and covered, and a car title in both our names with a common mailing address.

P. S. According to your timeline, you have had your interview. Was the RFE given after the interview? What does it specifically say and ask for. Very strange that after an interview you would get an RFE.

That is what I tought but the immigration officer told to show bonnafied proof of marriage i tought it wasnt neccesarry but i gues it was for her!! :/

Wait... you went to the interview without any supporting papers? No wonder you got an RFE! You should have taken all that you mentioned along with photos, personal effects, letters, affidavits and anything else you may have like travel itineraries.

No i took our marriage certificate, our wedding album and joint credit card, proof that i changed my name and the Officer as well went trough my phone pictures.

We plan to file with a copy of marriage cert, copy of insurance with her name on it, and a bank statement with both names and 3 months of transactions.

i think our problem was that we did not take a joint bank statement :( we did take our marriage certificate.

If you got all that, great. But many don't. And it's not required in the list for the 751.

For example, we have bank statements. No utility bills in her name, I owned my house before she got here. She isn't employed. No payroll checks (who pays with checks these days, anyways? Have only seen direct deposit for years). No W2 for her. Occupancy permit? What is that?

Affidavit is easy. As are pics. So in total, we have three things. But I doubt they refuse her ROC.

That's hardly any supporting evidence; I can see why you were RFE'd.

A marriage certificate is not proof of a bona fide marriage, it just means you were legally married. Photographs are also secondary evidence, since they indicate nothing other than you were in the same place at the same time.

They need to see shared assets or liabilities, such as joint bank accounts, joint life / health / vehicle / property insurance policies, joint leases, joint mortgage statements, etc.

In several states a marriage licence, once endorsed and recorded by the city / county clerk after the marriage, automatically becomes the marriage certificate.

What exactly did the RFE state? It seems very unusual that they would issue an RFE at this stage so it is possible that it is something as simple as the Marriage License vs the Marriage Certificate like Darnell suggested.

I did i took the original one to the interview the immigartion officer at the interview wanted proof that we were bonafied marriage i tought going through the k1 was enough proof but i guess it was not for her :/

I took the marriage license and a mariage certificate i took originals to them and the immigration officer told me it wasnt necessary because she had a copy of it on the aos packet :/
