Hi all,

Me and my husband have filed for consular processing and have applied for I-130.

After being waiting for 13 months to have I-130 approved. It finally happened!!! :) A big rock just fell off my shoulders.

As far as I know the USCIS will now forward the application to NVC, but how long can this take until my husband will receive the documents for AOS?

how far back does my husband have to show his tax returns?

To get the semantics out of the way, an I-130 is a petition form that is filed, not something that is applied for. Also, USCIS will be forwarding a petition, not an application.

To answer your questions, allow two weeks for the file to be transferred before starting to contact the NVC. It can take 20-30 business days before a case number is received (I had to wait 37 calender days before I got my case number from the NVC).

Don't wait for the NVC to send anything, be proactive and call them to obtain the case number. In the meantime, start preparing the needed documents for the applicable packages. September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

alas, there are 3 chunks of waiting time for NVC,after I-130 approval:

[assumption, petitioner is USCitizen, chasing CR-1 or IR-1]

1. transit time from USCIS to NVC - 2 weeks to 11 weeks, depending on which office adjudicated the I-130.

2. NVC Doc intake and fees processing - you two control the pace here. You mention NVC sending the petitioner AOS documents? no need for that, as that form is downloadable instantly (google I-864 for the form). Going as fast as possible, you still have to wait on the queues for review at NVC, so figure 7 to 8 weeks if'n you two go as fast as possible; NVC gives you up to 2 years to compete the NVC Doc Intake process.

3. case complete at NVC to scheduling to interview appointment - another 2 to 3 months.

Correct. NVC is not a time for "waiting". It's a time for action, starting about two weeks after petition approval.

Facts are cheap...knowing how to use them is precious...

Ilona, did you receive your case number yet? If so, I'm curious how long it took to get it and move on to the next steps in the process. I've been anxiously waiting to hear from the NVC about my wife and stepson, and called there to inquire about 10 days ago. They told me the I-130 petitions were approved by USCIS on 2/18, arrived at NVC on 3/10, and then would be entered in the computer system within six weeks (ugh), by 4/21. So now we're just waiting, and wonder if there's any action I can take now to help the process along more quickly. I suppose I'll call again tomorrow and ask if they can give me a case number, but I'd welcome any other suggestions!

Waiting is tough.It took me about 5 weeks from the NVC getting the case to getting a case # assigned.

I received an email with my case # and AOS bill.

Recieved 24 Feb, Case number email 31 March.

The NVC received my case on 2/21 and finally generated my numbers on 3/26. Everything was paid off, electronic forms filled out, and both the AOS and IV were sent off to the NVC last week. The latest piece of mail to arrive at the NVC was the IV packet, which arrived on 4/3. The ball is now in their court. I am waiting for the NVC to input the packets into the system. I'm guessing this will take at least two - three weeks.
