request of evidence for i-864

My wife petition for me, we sent forms i130,i485,i765, and two i864. Along with all this forms we sent all the supporting evidence. Today we got a request for evidence stating that we had failed to sent the joint sponsor's most recent tax returns and w2.

we did send them all this documents why are they saying we didn't?

also they requested an i864a for the joint sponsor's wife because he does his taxes jointly with his wife. The thing is that his wife doesn't have an income my sponsor makes 80k a year on his own. We explained this when we first sent out our documents. So why are they asking for this two things?

joint sponsor's wife does not have a SSN she has a tax number(itin).

Make sure you provide a complete copy of his return with all forms, schedules, W-2s and/or 1099s, OR a tax return transcript from the IRS, and his W-2 to show his individual income because it is a joint filing. Include a statement that his spouse does not have any income to contribute and therefore has no need to fill out an I-864A as his household member. Alternatively, have her fill out an I-864A even though she has no income. He should also provide proof of his current income as well. And proof of being a USC or LPR if it was not included to begin with.

They lost my tax return as well. Just sent in another copy and they were happy.

I had a similar situation. Just let ask his wife to fill in the i864A. There is is a check box there that she would choose as she has no income. But as long as they filed jointly , she also must file the i864a. then they'll approve your petition. Doesnt matter how much he is making, as long as they file together. Hope this helped.

It is not an actual requirement that a spouse must fill out an I-864A if they filed jointly. Some adjudicators may feel the need to request the I-864A from the spouse, but it is not an actual requirement of the forms. It is optional and used when the income of the household member is being combined with that of the sponsor to meet the income requirement. I believe some adjudicators ask for the I-864A, even when not necessary, because they want the spouse to sign off on their household income being used for the affidavit.

What Is This Form?

Form I-864A, Contract Between Sponsor and Household Member, is an attachment to Form I-864, Affidavit of Support Under Section 213A of the Immigration and Nationality Act. It is an optional form, completed and signed by two individuals: a sponsor who is completing Form I-864, and a household member who is promising to make his or her income and/or assets available to the sponsor to help support the sponsored immigrant(s). The combined signing of this form constitutes an agreement that the household member is responsible along with the sponsor for the support of the individual(s) named in this form.
