i130 for step daughter months after sending wife i130

I had an I130 filled for my wife on March of last year. At the time, the business office that filled my i130 for my wife said that I did not need an I130 for my 5 yrs. old step daughter.

They stated that my step daughter would get approval automatically when my wife gets approval.

Apparently, I do need to fill a separate I130 for my step daughter also.

Can anyone with knowledge shed some light on what to do in this particular case?

Fire the business office and request a refund. There are not derivitatives of USC immediate family petitions. Each person must have their own petition.

Yes you need to fill a separate 1-130.

My husband sent ours ( mine and my daughter 9 years old) in november, and we got mail by USCIS everything was fine..

When you complete the form (with fee and evidence of course) be sure to make a copy of your wife's I-797 )NOA1) and write a coverletter to have the daughters petition married up with your wife's so it can be adjudicated together.
