Hello, and thank you in advance for your responses..


Here’s my situation: I brought my now ex-wife (divorced almost 2 years) and her 3 children here on a K-1.. She is now on her own with her 10 yr. card.. She lives with her boyfriend a undocumented Mexican. She continues to get state and town aid for heat, electricity and food stamps. I understand I am still on the hook with her as far as being responsible for her and the kids according to the I-864.


I want to bring my fiancée in to the country with her son on a K-1.. We’ve been together for a year with me visiting her as often as I can..


My question is this.. When I file for the K-1 how hard will they look into my past I-864, and will I need to meet income requirement's for not only my fiancée and her son but also for my ex and her kids? I’m also concerned they will discover she has been getting aid and want me to reimburse the state for what she has been receiving?

You will have to claim all the persons you previously filed an I-864 for on the current I-864 (unless they meet certain conditions which according to your post they do not). Assuming it is currently just you in the family you will have to show 125% the poverty income for 1 (yourself) + 4 (prior wife and three children) +2 (fiance and child) = 7 persons.

Gives a slight hint that the USCIS is not the least interested in protecting a US citizen if a victim of fraud. Sure read about this when I first got involved with immigration and my attorney at the time strongly suggested my wife file an I-864A so would be equally responsible. She had no objection to this so we were entering our marriage on an equal basis.

We also had that long wait before I could bring her over here and we certainly had our share of complications we were able to work out together and for each of us, this was that one in a million person.

Only person to protect yourself against fraud, is you.

So you're thinking if I only list the 3 of us on the new 864, I'll get RF'ed for not listing the 7?

You are more apt to just get denied

The instructions state to report other immigrants you have sponsored. The have your social security number you think they won't know? ommiting gets an RFE lying gets denials.

This will not be over quickly. You will not enjoy this.
