worrying about filing single

Hi everyone,

I am about to file my AOS application but what is making me worry now is my husband mistakenly filed as single on our 2012 tax return and now we want to amend our 2012 return . Can someone answer us how to amend the tax return if I still don't have SSN or ITIN.

No big deal. If your husband made less than $76,000, I don't remember the exact number, he paid too much and will get a refund for 2012 with an amended return for married status filing jointly.

Just file an amended return with a W-7 and some copies of your ID's like foreign passport. It gets sent to a different address than what's on the 1040 form.

We've just gone through this. Luckily, my spouse is still offshore, and we were able to go through the US Consulate in Australia to get the proper certification. It only took 5 days this way.

We just got the certified passport copy. We're in the middle of the I-130 process - and we don't know when her interview might happen. So we trusted a 5-day commitment from the US Consulate in Sydney more than we trusted the "we-might-keep-your-passport-for-60-days" of the IRS!
