I know that i do not need to make an infopass appointment as yet for my ead, but i was just checking how to do it in case i dont get it approved in the 90 days...it keeps coming up that you cannot make an appointment at this time and it has been saying that for 2 days now. Can you not make infopass appointments about your ead anymore? If not then what can you do apart from call the service centre?

I cut and pasted the below information from the USCIS website;

If USCIS does not approve or deny your Employment Authorization Document application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim Employment Authorization Document. You must go to your local USCIS office and bring with you proof of your identity and any documents that USCIS has sent you about your employment authorization application. See our USCIS field offices.

I have seen some people on this forum try to say that USCIS no longer does this but that is c*rap because they do.

nathan, you may be correct regarding a minority of offices, however many are using the new mandate in which the local offices can only send a service request to ask what is holding up the process. The *can* however request an interim be created, but the local office, again, cannot create the interim.

QUOTEInterim Employment Authorization Document

USCIS is required to adjudicate a pending Form I-765 within 90 days from the date of receipt. 8 CFR 274a.13(d). Failure to complete the adjudication within this time frame requires the Service to grant an employment authorization document for a period not to exceed 240 days. The following steps are being initiated to reduce, and eventually eliminate, the need for USCIS to issue an interim EAD.

Field Offices

Local Offices will no longer accept and adjudicate Form I-765 for an Interim EAD. The Service Centers or NBC will be responsible for adjudicating the pending I-765 and issuing interim or non-interim documentation. Upon receipt of Form I-765 requesting an interim EAD, local field offices are required to perform the following tasks.

• CLAIMS Verification

o Underlying application remains pending

o Determine if RFE has been issued, thus tolling the 90-day adjudicative requirement

o Form I-765 remains unadjudicated

o Biometrics have been captured—if not, refer to ASC

Thanks for the info. It seems that you still apply at your local office, but that local office can not give temp EAD's. The service centre then sends it all away for the NBC to either approve your origional I-765 or grant a Temp EAD.

Am I reading this correctly?

I believe that that message just means that there aren't any appointments available at that time, my understanding is that you can still make an appointment, you just can't immediately get an interim EAD.

I had not seen the reports that you could no longer get a walk in EAD, and we actually went to our office today to get one. We were told that about three months ago, people came and physically removed all of the machines from theirs and other offices. Apparently, there is a new process and law that the Missouri Service Center is supposed to allow them to go through them within the 90 days... Now all that they can do is make an inquiry and send another request. It just so happens that ours was approved on Jan 3rd (day 89!) even though our case status never changed and supposedly is at the printer... we'll see!

This is the response I got when I e-mailed our District Office.

"Service records show the extension of employment authorization for the applicant was approved. A new employment card will be mailed to the applicant."

That was on the 27th December. My son's application was received in Missouri on the 21st September and they have, and they are, according to the USCIS website, completing applications made now after the 27th Sept.

I have e-mailed our District Office to ask if they can issue an Interim EAD at the office on Tuesday (when we have an INFOPASS appointment) or if they can only make an inquiry of Missouri. My son's EAD expires on Thursday. I will let you know what their reply is.

When you request an INFOPASS it specifically asks if your inquiry is because your EAD hasn't been issued within the prescribed 90 days. You would think that, if the office can't issed an interim document, that there would be some procedure in place where you can request an inquiry be made, if they can't physically issue an interim doc.

Anyway, fingers crossed!

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!
