Hello Friends !

My wife is my primary sponsor ( Petitioner ) but she can not fulfill AOS so we have joint sponsor ( wife uncle ) .

Now my wife is filling I-864 form but i am confused about joint sponsor form .

Some says joint sponsor (wife uncle) need same form ( I-864 ) & some saying he need ( I-864A )

If he need I-864A then what is the difference between I-864 & I-864A form ?

2nd thing we don't have NVC case number yet so can i fill up I-864 form by downloading from USCIS earlier for save time or i need to get it from NVC after case number ?

I have mentioned the link of I-864 , is it rite form ?

HI! I-864 is the correct form for your wife, and I think is correct too for the joint sponsor beacause I open this form, and at Part 1, point 1.d. I'm the only joint sponsor.

So I'm not really sure, better call NVC and ask.For your second question you can download this form from uscis website. Call to NVC everyday for you case number & Invoice ID.

The link has the correct form.

Your wife will need to file that as form regardless of whether she meet the income requirements or not since she is the petitioner.

Your uncle will need to fill up another (same form).

If its only your uncles income on the return there's no need for I864A

If your uncle has combined income (income from spouse) then spouse needs to file I-864A.

Petitioner = I-864

Joint Sponsor = I-864

Joint Sponsor Spouse = I-864A ( if joint sponsor's income is combined )

You will need to send supporting documents for both you and your joint sponsor.

For AOS, you do not need to wait for your case number. You can have AOS done before hand and send it once your payment portal for AOS shows as "PAID"

Also gather up all the required documents for IV package as well and have them ready to be shipped out as well.

Of course, double check and triple check all the docs specially your AOS.

  • 2013-10-28: AOS payment available and paid
  • 2013-10-30: AOS Shows as "Paid"
  • 2013-11-01: Mailed i864 docs
  • 2013-11-01: IV fee available and paid
  • 2013-11-01: AOS Docs received at NVC ( Based on USPS tracking )
  • 2013-11-04 IV Supporting Docs mailed ( IV payment still shows as IN PROCESS...but moneys already withdrawn from account)
  • 2013-11-06 IV Supporting Docs received ( Based on USPS tracking )
  • 2013-11-07: IV Shows as "PAID"

2013-11-07: Received/Entered both AOS and IV in the system for review.

  • 2013-11-08: DS 260 completes and submitted.

2013-12-05: Received checklist for AOS

In Part 4. Information on the Sponsor, please correct the following...

[x] Item 12. As the petitioner sponsoring your spouse or child, you must indicate whether or not you are currently on active duty in the U.S. armed services.

In Part 6. Sponsor's Income and Employment, please correct the following...

[x] Item 10. The current annual household income must equal the sum of items 5, 6.c., 7.c., 8.c., and 9.c.

  • 2013-12-05: Sent checklist response for AOS
  • 2013-12-07: Received "false checklist": IV Docs reviewed and accepted

2013-12-11: Entered checklist for AOS into system

2014-01-06: Case Complete per call to NVC.

2014-01-29: Interview Date assigned

2014-02-03: CEAC site updated to "In Transit"

2014-03-04: Interview Date

2014-03-04: VISA APPROVED. pickup on 2013-03-06
