Ok so my fiancé entered the US on January 9, 14. Before he arrived I never felt so sure of something in all my life! I was so happy, overjoyed, excited! I was so in love! My trip to see him was amazing! (Of course I did pay for everything, and it was vacation not reality). I have my wedding dress, I have my girls' dresses! Finding out on Christmas Eve that the love of my life would be here at home with me very soon was the best gift ever! So he's here... I was very happy to see him but it didn't take long before I realized something's not clicking. I started to have anxiety all the time, I don't feel comfortable around him at all. It's bugging me out! So fast forward 1 week and 6 days and I finally spelled it out to him that I could not and will not marry him because we are not even in the same book of life! I couldn't take it anymore. I can not live with him! So fast forward to last night and he puts his brother on the phone whom lives in CA and his brother tells me if that's my final decision then he is booking my fiancé a flight to CA to depart a week from now and he will call his attorney and have him draw up all the paperwork to relieve me of any financial responsibility! Has anyone ever had a similar experience or heard of one? Should I call USCIS? Of course I will never sign anything without my attorney looking it over and discussing it with USCIS, I may have been conned by lust but I'm not stupid! I'm curious if anyone knows of a possible outcome? Thanks!

so, what happens when you sign nothing in the turkey poo pile, and not marry, and not file AOS?

--the K-1 visa holder only has 90 days in the USA

--the K-1 visa holder SHOULD return to his home country, as after the I-94 expires, will not have any legal presence in the USA

--the petitioner has no further responsibilities. No further paperwork to file either.

IMO, your K-1 visa holder will scamper off to his brother's house, get his SSN (which he is entitled to) and start to live and work illegally in the USA.

Still, even he does that, you are not responsible for him, the I-94 expires soon.

IMO, your K-1 visa holder will scamper off to his brother's house, get his SSN (which he is entitled to) and start to live and work illegally in the USA.

That would be the obvious conclusion. The SSN will say not valid for work but I doubt if ever had any intentions of going home no matter what happened.

Does beg the question how this got past the Consulate. Seems to have the flags of whatever colour.

It's funny to me that everyone else in this thread is saying things like "don't let him come back to your house" when the OP is clearly at fault here (if her description of the situation is accurate). She brings this guy over and decides in a week and a half that they are not alike? And you are more worried about her? rolleyes.gif

Let's be realistic. I don't see the OP trying to attack this guy somehow if he's around. But he, who has stuff to lose now, can you vouch he wouldn't do anything unreasonable? Who knows how it can turn out. If she's decided not to proceed, it's her right. But why she shouldn't be cautious i don't see, really.

Wow! Absolutely......LUST doesn't last !

I hope you are very sure of your decison. He just arrived Jan 9, that was only few days. It is only 25 Jan now, why it was so easy to have a change of heart / mind ? Last Christmas you said that you were so excited of his coming. I am wondering why it is so quick for you to make a huge decision. Would you mind sharing the reasons behind? Have you discovered something to make you change ?

Anyway, if you really have decided, then do what other VJs have said to protect you, just in case he will file for any immigration benefits.

I think you can't stop him from going to his brother. He has 90 days to stay in the US. And, at least he could maybe request his brother to help him buy a ticket.

Just a reminder to everyone, if ever, please make sure you know what you want before filing a petition. Please get to know better....more time face to face. Relationship requires work and time. A Fiance / Fiancee is supposed to be someone who is engaged to marry. It is not easy giving up everything in home country just to be with love one in a strange country; It takes courage and positive outlook....and more, it is not easy to feel rejected and mend a broken heart.

and now you're saying that you made a mistake and you don't want to marry him. You don't need to do anything, you've already done it...you gave him grounds for that VAWA stuff. A lot of men and women use it as a tool for staying in the country by making up lies that the spouse/fiancé kicked them out, wont adjust the status, etc. In this case...it would be totally valid if he went that route.

What exactly did the OP do that would constitute as abuse? Telling someone you're not ready to marry them is not one of those things. Here USCIS describes who's eligible to file under VAWA and i don't see how it would apply. Though this is exactly why she is advised to stay away from him now so he cannot make this stuff up.
