So I am very saddened to see I am one, if not the only, one left on VJ from January of last year having yet to receive a NOA2... I have consulted a few attorneys and they were kind enough to tell me there isn't much they could do for me at this stage in the game. One did provide me with a direct contact at Newark and I received a letter yesterday from my last request for expedite I did over the phone... the letter is addressed from Homeland Security, and the Newark office. In the letter I am asked to submit the request for expedite by mail again to the Newark field office.... I did it over the phone with Tier 2 and they asked a few questions and filled out the request... now I have a letter asking me to do the same thing all over again but this time send it via mail... So could I consider this a good sign? ....

Also, has anyone done a request for expedite?? What could I base it off of USCIS error?? Because all the other criteria is not my case... What would someone who has been waiting for atleast a smoke signal for a WHOLE YEAR now base their expedite on? Considering that is not a criteria... I guess I would have to go with USCIS error. Please give me your thoughts or suggestions.

The attorney suggested I scan and copy all my requests and receipts from USCIS and write a letter to this contact along with an email and hope it gets me somewhere. Also, there is one thing one attorney told me she said its a bad sign that the petition is even at the local field office because it should have been adjudicated from NVC.... but I remember there being some sort of backlog and they sent all petitions to local field offices... however mine has remained stagnant as of May 2013 when they transferred it and is most like lost in a dark soggy corner somewhere. cray5ol.gifmad.gif

Wow January of last year :( This has got to be hard. Have you tried contacting your congressman or senator and tell them your situation? I would be going crazy and they can really help you in a situation like this.

Cases are not adjudicated at the NVC. After a petition is approved it is forwarded to the NVC for visa pre- processing of the visa itself. They invoice the visa processing fees, collect the visa application and documentation, and they hold the approved petition until the interview is scheduled with a consular officer at the US Embassy in Amman.

Wow January of last year sad.png This has got to be hard. Have you tried contacting your congressman or senator and tell them your situation? I would be going crazy and they can really help you in a situation like this

I faxed two letters to the Senator. They do not pick up the phone in their office. I sent an email to my district congressman last week because the Senator is obviously useless and I am in the process of mailing all the other stuff. I work in a very demanding field I have no time to chase people around I have to do paper trails - which is why its taking me forever... this was my biggest fear because I have no time... I hate every minute of it.

Ok, here's some questions: Have you done an infopass and put in a service request? Have you attempted to contact the ombudsman? If you've done these, as well as contacted the senators and congresspeople (and yes, I know how useless they are. I'm from NJ too.) you may want to consider spending the money to hire an attorney and file a Writ of Mandamus. Even the threat of it might be enough to get your case finally pushed through.

I thought so. :( It might be worth it to research it as an option. There are other members on here (Gogo and at least one other whose name currently escapes me.) who have filed one with a positive result. My understanding is that it doesn't make sense before you've been waiting a year at least. (Before a year it will just get you denied.) But after a year, it's definitely an option.

I really don't know much about the mandamus except that I know there is a certain time and place for it, what that time and place is, I have no clue I only know if done too early it can have a disastrous outcome. Mari you should go to immigrate2us.net and do a search for Laurel Scott, she specializes in difficult cases, she does an open chat and gives free advice there. Perhaps she has suggestions for you, it's worth a shot. You can do it from the comfort of your own home or from work, I know that you cannot take any more time from work, so it's an option.

My understanding is that a Writ of Mandamus before 1 year and without having contacted Senators, Congresspeople, USCIS itself via email, phone, and infopass, and Ombudsman will result in a denial. If you've been waiting a year, and have done everything in your power to find out what the problem is to no avail, then most times they will adjudicate it after getting the letter that states your intent to file a Writ of Mandamus against them.

Mari, if you'd like, I'll try to find the information I was looking at and post it here for you. Like I said, you can also read up on what Gogo went through with his wife (it's in his signature).
