Happy new year,

My wife is going to file for her daughters with the I-130 and I-864. We would like to have my brother help us with his income as a co-sponsor with the I-864A.

When I brought my wife as a fiancee he helped me sponsor my wife. At that time I had been living at his house. We have since moved out on our own. Do we necessarily have to have the same residence? Can my brother help me if he has already sponsored my wife?

We got married in May 2005. We went through adj. of status and she received her perm. reside. in January of 06. Her daughters are 20 and 22. The youngest turns 21 in April of '07. My brother help me sponsor her when I sent the paperwork in Nov. of 2004.

It will take a very long time to get her children over here as they are over 21.... years infact.. your brother can be a co-sponsor you dont have to live at the same address... but he will need to have enough income to cover all the immigrants and members of his household at 125% of the povery line.

she will be able to update the applications once she becomes a citizen but again that will take a until Jan 2009 for her to be eligable to become a citizen.

Your brother can be a Joint Sponsor, he cannot be a Household Member.
