Hello guys!

I've been following this forum since September 2013. I had never actually registered because all the posts have always been very informative.

But now.. I have a problem I do not know how to fix.

Our papers were filled in on Oct 25th, 2013. We got the NOA2 (approved) on Nov 26th. I went and did my medical exams on Dec 10th.

But now it's Jan 23rd.. and the NVC never received our papers from the UCIS. We've sent them over 15 emails, with all the papers we received from the UCIS (Notification of Receipt, NOA2, AND an extra paper where the UCIS recognized they "forgot to send", saying it would be sent in an expeditious fashion to the NVC. My fianceé got this letter on Dec. 24th).

We have both called the UCIS and the NVC (and since my fianceé is the petitioner and I'm the beneficiary, they won't talk to me at all, only to her), they're absurdly unfriendly to the point of not even answering questions, they do NOT forward us to Tier 2 supervisors when we request it and they refuse to give us any information.

My fianceé contacted the office of Kansas' congressman for the 1st district and reached some lady who is responsible for their immigration assistance. She said "all we can do is push, not much else". She requested my fianceé to sign and scan an information release form in order to help us.

But until now.. we haven´t received anything.. no #RDJ.. no transfer receipt.. nothing.

Could anyone shed any light onto the subject?

I don't really have an answer for you, but your USC petitioner could try to call the DOS Visa Unit. (202) 485-7600, option 1, option 0. They're usually much more helpful than the NVC. Explain what has happened and ask them if they could manually locate your casefile.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Called the DOS Visa Unit but then again.. my fiancee would have to call them and she´s insanely busy with work atm..

And also just got this:

Dear Sir/Madam,

The National Visa Center received your inquiry and the attached I-797
Notice of Action - Approval Notice. Unfortunately we do not have a
record of receiving your approved petition from the Department of
Homeland Security's Office of U.S. Citizenship and Immigration Services
(USCIS). To assist you in determining the location of your petition the
NVC will contact USCIS on your behalf for information on the location of
this petition.

This is the 8th email from them.

I seriously have no idea what to do.

The congressman did nothing.

Calling the UCIS is pointless.

Calling the NVC is pointless.

Calling DOS is pointless.

I've seen petitions here filed AFTER mine and they already interviewed. Does anyone have any ideas?

Please, it feels like no one is moving a finger to help and we are slowly growing desperate.

When did you put in a service request or scheduled an INFOPass appointment.

When calling USCIS you must be precise or you will never get a Tier 2 Supervisor. When they answer the phone that's an operator. You need to say you need to speak to a Tier 2 supervisor, PERIOD.

Once you get one (you could be on hold a long time) you ask this:

"When did my petition physically leave the service center". They know exactly if it did. I know when I called every day to NVC and it wasn't there after 30 days went to USCIS and the supervisor said "its still here you want us to send it". It was at NVC the next day..

You have to be diligent if you expect results. First on Monday call and do what i told you. Report back and tell us what happened. It does you nothing to contact DOS and NVC because they don't have your petition USCIS does.
