Not being able to visit the USA during the I-13O process?

Does your son have his American citizenship? Birth abroad and all that? If so, it will make it that much harder for your wife to visit the US with him. They will say your husband is American, your son is American why would you go there, then return to Vietnam?

Not going to happen here in Vietnam.It's a high fraud country and MANY overstay their visa in the US. I Can tell you from first hand experience in almost the exact situation you are. However, like you said you will only be out $160, so might as well try. Let us know if it was successful.

Yes my son already has his CRBA. I live in Vietnam and my company buys my flights in and out of Vietnam, we have a rental contract on a house and bank accounts in Vietnam. Her family is there and I've actually gone fond of my mother in law.

She probably will get denied but I don't see the harm in trying. I've blown way more money than that on dumb #######.

For me doing this is more family politic's motivated.

I'm doing this to quell my sister in law (my brothers wife). She is one of those people that knows everything including visa's and travel. This comes from someone who went to Denmark once. Meanwhile my career has taken me to 40+ countries and my passport currently has 150 visa pages with all but 30 pages stamped now. I like to think I know what I'm doing when it comes to visa's although the US process is a new one for me. My sister in law keeps telling my family that I can get a tourist visa and I'm not being truthful about the length of time it takes to get the CR-1 visa. If the wife applies for the tourist visa and gets it great; if denied I can at least rub it in my sister and laws face.

I got some weird family politics at home. Actual I'd like to vent about it if I can find the right place to post. I spend time with my wife and her family I have zero stress. I wish I could say the same in the US.

USCIS refuses to allow me to visit. Since my husband has now moved all our household belongings back to the USA they will not let me through.

USCIS has nothing to do with whether or not you are granted admission; it is US Customs and Border Protection (CBP) that has refused you entry.

Hi Everyone,

Just my 10 cents worth, but I visit my wife regularly (8 times in the last 2 + years) under the ESTA scheme (on my 3rd ESTA now) and I just answer the questions asked at POE honestly and indeed tell the Officer that I'm here to visit my wife and family when asked the purpose of my visit. They sometimes ask questions like - What does she do for a living? Who does she work for? Where does she live? Just answer honestly. Very occasionally I have been asked if I intend to move out to the US - again I tell the truth and tell them exactly the point in the I-130 process we are at and they sometimes ask what job will I be looking for when I move and then my passport gets stamped for three months and I'm on my way!! I have never been asked to provide any further proof of ties back in UK, although I do carry the latest paperwork relating to our application - ie- NOA2 currently.

Just for additional information I always fly in and therefore POE in Chicago!! And I rarely stay longer than a typical vacation period - 2 to 3 weeks - I wish I could stay longer but work dictates that I need to be back at my desk unfortunately.

Here's hoping that my next trip will be one way!! Whoo Hoo!! We are at NVC and have a case number so we get closer to finishing the process everyday!!

what the laywer said is pretty consistent from what ive heard from others, including our own

the person you have sponsored obviously has immigrant intent, so the border officer can refuse entry....its very low chance, our lawyer puts it at 3% in his experience.

the "ties to the community" is subjective....b/c guess what, once your spouse paperwork comes thru the spouse is leaving that community/job anyways

I am Permament Resident, and I filled I-130 for my husband while ago. I got noa2 already, and today he entered US in POE Chicago today without any problems. On B1/B2 visa for buisness trip, they just asked him how long he is going to stay and what he is doing for living. Not a single question about return ticket and they didn't mention I-130 at all.

Hi all,

Ok so my wife spoke to an immigration lawyer today for some advise, we have already filed form I-130 and received the notice/receipt.

She did ask weather I would be able to come into the USA on a VWP (Visa waiver program / standard tourist visa which allows a a tourist up to to 90 days to remain in the USA) and he replied and was adamant to say that I should not do that as it could delay / mess up the I-130 process! I have however asked on the forum before and others have stated that they did do so and had no problems.

So my question is has anybody had any problems with this? Of course having a return flight ticket already booked and ties that show your 'need' to return back home is a given.
