Applying for another visa (To another country) during the CR-1 process?

Hey guys,

Just a quick though after realizing that the I-130 is going to take so long due to the backlog (I've just filed my I-130 and have received the confirmation).

My wife and I are desperately trying to work out how we could possibly spend 11 months apart.. and we came up with the thought to live in Korea whilst we wait for the I-130 / CR-1 to be approved / issued. My wife is american but she's half korean and has family there.

Now, my question is: Will applying for a visa to live in Korea for a short while, mess up the process for the I-130? Even though they are separate governments, I would be applying for the korean visa in the UK for which I am the beneficiary to the I-130 visa.

Probably not the bets wording but I hope you understand what I'm tyring to say.

Any help would be super useful!

Timeline

I do not believe that should have any impact on your I 130.

Just make sure that if you do live more that six months in Korea, then make sure you get PPC from Korea.( will be needed when submitting your IV package if stay > 6 months)

Is your wife living with you in the UK now? Or is she in the US?

If she's in the UK now, Did you do the I-130 petition from the UK as DCF (direct consular filing)? If so, it might cause problems. DCF is extremely quick compared to regular filing. In fact, if you didn't (and are eligible to do so) it would actually be worth your while to cancel the regular filing and do DCF.

If she's in the US now, and the two of you decide to go to Korea to wait, I think the only issues would be with getting the updates that USCIS will (eventually) send, and potentially having to leave Korea abruptly to go back to the UK and have your interview and whatnot.

I don't think the act of getting a different visa, for a different purpose, from a different government, in and of itself, would cause any problems.

I don't think it will mess up your process. Your file isn't going to get touched for a few months at least (September filer here, hasn't been touched since they took our money!).

Whatever Embassy you listed on the I-130 as where you'll be getting your visa from is where you'll need to be once the I-130 is approved. I'm not sure what Korea's immigrant rules are, but I would look into that before going there for an extended period of time.

P.S. I think it's great you both have some way to be together throughout this ordeal! My husband and I only see each other every 3 months and it is TOUGH - but, as he says, a few months apart is worth having the rest of our lives together :)

you also need to be a resident of the UK if you are doing DCF, it's one of the requirements

My wife is living in the USA whilst I am here in England. Oh my I was aware of the DCF but I thought it was for government personal only living abroad???

What are the requirements because I briefly looked into it and it was sooooooo much faster. Please if you know anything about the DCF let me know! I will do some research myself now. I am a UK citizen too.

I know the process is so long, it's good to see we're not the only two suffering - it's been pretty rough so far and we've only really just begun the wait which is why we're looking at other options!

If money wasnt an issue it would be ok it's just that flights to and from the UK - USA get's really expensive as you can imagine.... but as you quite rightly said it is very much worth the wait in the long run :)

But as I recall, the UK visa process is quite simple. It took her a maximum of 3 months to get her visa in her passport, and you have the London embassy close to you when it comes to interview time :).

We are considering of cancelling the I-130 in the states right now, but are worried if we did that, we would have to wait longer. It's a risk to take to be honest, but yes last time I check the I-130 processing times in the UK were 30 days..!

US London Embassy website! (IF I saw this before then, I would have filed through london with much ease!)

We had our fair share of being apart for a long time, but it has been nice we haven't been apart for over a year now..! Just hope USCIS gets through everyone's I-130's to be back with their families!

Timeline

Not sure what the timelines are now but why do you not apply for her to immigrate to the UK, it used to be just a few weeks.

DCF seems irrelevant to the topic.
