Good afternoon all,

My dad got his visa in 2009 and visited the USA in 2009-2010. He actually stayed for 3 months and left teh country within the time allocated by the immigration at the point of entry.

My question is: my dad did not visit the USA since he left in January 2010, is his visa still valid or not?

some people told me that if it is not used, it expires in 3 years.

Can somebody actually clarify this for me?

His greencard would have been considered abandoned when he didn't return after 1 year. The expiration has nothing to do with it.

i don't think said person is in possession of a greencard, sounds like he has a b1 maybe? but you are right, dwheels76, if he was in possession of a green card, his status would be considered 'abandoned'.

it is a B1 10-year visa!!!!

So check its validation and you'll know if his visa is still valid.

It doesn't expire just because it's not being used for any amount of time.

If he got his visa in 2009, it should be valid till 2019.

More likely a B2 or a B1/2 combo.

etrangais his Visa is valid, my mother got her Visa on 2010 and she did not visit USA untill 2013 so three years after she got her Visa, and she was able to get in no problems, also she went to Canada (With Canadian Visa and renter USA with US visa) so i believe the visa its still valid and not consider as Green Card

and everyone he is talking about VISA AND NOT GREEN CARD, with Greencard you will need an extended stay outside US and can be done at Local office.

I don't get this either, and we are talking about a visa for a non-immigrant that is in a foreign passport, right?

Mom-in-law a non-immigrant had a ten year B1/B2 visa that is odd, because her foreign passport is only good for five years that expired. So wife told me with her new passport has to apply for a new visa, the old one is glued into her expired passport.

Said the US consulate in Colombia wants 110 bucks for a new visa and she doesn't have that kind of money. Well sent that money to her was my reply. We are thinking since she already has a valid visa, she won't have to go through all the BS again to get another one.

See what happens, first time it took her well over a year to get that first visa, she is planning on coming here in six months.

All I can suggest is to have your dad check with the US consulate in his home country. Should get a far better answer than asking here.

What I really know about this subject, US consulate wants another 110 bucks.

What I really know about this subject, US consulate wants another 110 bucks.

First, the non-immigrant visa application fee is $160, not $110.

Second, this has nothing to do with the US consulate wanting money. It's more the foreign government wanting money by only issuing 5 year passports.

Finally -- and most important -- there is no reason for you MIL to apply for a new visa. The visa is still valid. Your MIL needs a new valid passport. She will then need to carry both passports -- the one with the visa and the new valid one.
