Including an infant

Timeline

We have a cousin that applied for and won a DV in Nigeria. When she applied she did not include their infant son. At the time he was less than a year old and could not stand for the passport photo required for the application. (Of course they got bad information and didn't ask the right questions.(or me)) Fast forward they were advised they had won. Then at the interview on January 19 consulate refused to interview them because they had not included the child on the original application. What is their next step? They were given two forms. (1) DS 230 part 1-2 and, (2) DS 122. Is it possible to adjust the paperwork to include their child and if so how?

Well they were given the forms to add the child so I suggest they do so and get all necessary documents to embassy ASAP. One they do that and embassy reviews then they will be called in for interview.

I was just going to ask that. Too many post on same subject. They are really up a creek now that I have read. I will post what was found for future readers of this topic. Sad. They blew their chance.

"Failure to list all children who are eligible will result in disqualification of the principal applicant
and refusal of all visas in the case at the time of the visa interview."
Unless the child was born after you filed the application you has disqualified yourself by not following the instructions.
Don't try to cheat the system by lying and saying you don't have a child because a later petition for the child will result in a finding of misrepresentation and a loss of the green cards and deportation for anyone who obtained a visa from the lottery.

Yup... That's them. My hubby told them to come here and ask the question and no one told me. What a mess, they are heartbroken. Do they have any options or is it game over?

I'm very sorry for your cousin, but people don't need to read the forums, they just need to read the instructions on the lottery entry form. Every year there are people disqualified because they didn't include a spouse or children on their entry, when the instructions make it very clear that they will be disqualified for doing so.

By the way the baby doesn't need to be standing for a photo... One of our entries was when our baby was a few months old, you can take a photo with the baby lying down, you just need head and shoulders after all.
