I130 RFE spouse, consular processing

Timeline

I am a Canadian citizen and my husband is sponsoring me through consular processing. We got married in Feb 2013 and applied in July through a Canadian lawyer, at the time of application my husband was a green card holder. He became US citizen in October 2013 and we sent his naturalization certificate soon after to upgrade my file to CR1



On Dec 14th we received RFE letter from USCIS asked for a different format of marriage certificate. We sent that On Dec 27th. Currently my I-130 case status shows RFE in response view.



My question is, does I-130 needs to be approved first before my file can be upgraded to CR1 from F2A category. Also what is the timeline for I-130 approval after USCIS receives the required documents.



All your help will be greatly appreciated.

I don't actually know the answer to your question, but according to the USCIS' posted data, an LPR filing for a spouse is actually being processed faster than a USC right now. Maybe you should just leave it as is?

I think it's better to leave it on F2a category in USCIS coz processing time for f2a in uscis is faster than ir1 then upgrade when it reaches nvc so u won't have to wait for vb to become current.
